DEC officials were on site all weekend near Hale Eddy, responding to the spill & clean-up of diesel fuel into the West Branch of the Delaware River, from last Thursday's
New York Susquehanna & Western railroad derailment. A small culvert & the railroad bed washed out after recent flash flooding, 2 Locomotives derailed at that site, and
number of other cars derailed further back on the line, with a couple of cars entering the river. Most of the railroad cars have been removed & the clean-up &
investigation is continuing.
The 132nd Delaware County Fair gets underway at the fairgrounds in Walton today, spokesman Jason Craig comments:

State Police arrested 23 year old Daniel Shelton of Unadilla for DWI after Troopers were dispatched by Delaware County 911 to a report of a vehicle in the median on Interstate 88. Troopers learned that Shelton was traveling in a westerly direction when he veered to the right, struck a guiderail then crossed back toward the median. Shelton was arrested & was released to a sober third party and will appear in the town of Sidney Court on August 23rd.
The Otsego County health Department reported that a raccoon in the town of Mt. Vision, tested positive for rabies last week. The raccoon attacked a dog on Wednesday, 1 person came in contact with the raccoon while attempted the save the dog. The dog was up to date on its rabies vaccinations, and required a booster that evening. The next rabies clinic in Otsego County will be Tuesday from 6:00 to 8:00 PM at Neahwa Park in Oneonta.
President Trump is planning to stop in Central New York today, first he will stop at Fort Drum in Watertown to sign a defense bill, then he will attend a $1000 a ticket fundraiser at an undisclosed location for Congresswoman Claudia Tenney, who is seeking re-election for a 2nd term to the 22nd District against Democrat Anthony Brindisi. Brindisi will host a fundraiser tonight in Utica; Tickets will start at $10 and can be purchased online in advance or at the door. The event will take place at 6:00 PM at Chesterfield Restaurant in Utica.

Rock was arrested and arraigned in the town of Morris; she was released on her own recognizance pending additional court action.

State Police reported that 2 train cars derailed near Hale Eddy in the town of Deposit at about 2:20 this morning. The engineers of the freight train were not injured, high river water washed away the rock & a culvert underneath the tracks, some diesel fuel entered the West Branch of the Delaware River, the DEC Hazmat team has responded. The 2 derailed cars are hovering over the river, but did not go into the river. The clean-up & the investigation are ongoing.
State Police at Binghamton arrested 45 year old Bobby Galusha of Harpursville for Criminal Trespass and Criminal Possession of a Controlled Substance. Troopers responded to the report of a couple in Windsor finding an unidentified man in their home. Galusha was arrested, he is accused of possessing suboxone at the time of the arrest, he was released on appearance tickets to the town of Windsor Court on August 15th.
Governor Cuomo today announced that he will propose legislation to further decouple New York State's tax code from the federal code if President Trump moves forward with a plan for a $100 billion capital gains tax cut for the rich. The Governor also called on Congress to immediately block any attempt by President Trump to unilaterally cut taxes for the nation's wealthiest 1% in violation of the Constitution. Governor Cuomo and Attorney General Underwood also filed a lawsuit to protect New York and its taxpayers from Washington's drastic curtailment of the state and local tax deduction, which argues that the new SALT cap was enacted to target New York and similarly situated states & that it interferes with states' rights to make their own fiscal decisions.
President Trump is scheduled to visit Fort Drum in Watertown on Monday, and is also expected to make a campaign stop in the Utica area for incumbent Congresswoman Claudia Tenney of the 22 District. Trump is expected to sign a $716 Billion dollar defense bill at Fort drum before the Tenney Campaign stop. Tenney faces a battle in November against Democratic Anthony Brinidisi.
State Police arrested 34 year old Darnell Ney of Port Crane for Criminal Contempt, after Troopers were dispatched to the town of Fenton, where a person with an order of protection against Ney was allegedly contacted by him from the Broome County Jail. Ney was arrested and arraigned in the town of Fenton Court and he was remanded to the Broome County Jail without bail.
Oneonta Police arrested 2 area men for allegedly stealing a van & bicycles 17 year old Michael Roman & 26 year old Benito Brito were charged with 3rd degree Burglary, 3rd degree grand larceny, plus criminal mischief; both were being held pending court action.
Deposit Town Supervisor Thomas Axtell has declared a State of Emergency for Town roads in Deposit due to excessive rainfall and flash flooding. Supervisor Axtell has requested no unnecessary travel on Town roads until further notice. Also, Deputy Town Supervisor Patrick O’Brien from the Town of Hancock has issued a Travel Advisory for all town roads in Hancock until further notice due to excessive rain and flash flooding. No unnecessary travel is requested.
The State Department of Health confirmed the presence of Eastern Equine Encephalitis Virus in mosquitoes in Onondaga and Oswego Counties. EEE is a rare, viral disease spread by mosquitoes that can affect people and horses, people over 50 and younger than 15 are at greatest risk for acquiring the virus. Most people bitten by an infected mosquito will not develop any symptoms, severe cases begin with the sudden onset of headache, high fever, chills and vomiting, approximately a third of patients who develop EEE die, while many patients who survive EEE experience neurologic impairment. There have been no human cases of EEE this year, there is no vaccine. Officials suggest keeping mosquitoes away, by eliminating standing water in yards& using Repellents that contain DEET, IR3535, or oil of lemon eucalyptus.
Delaware County Sheriff Deputies responded June 3rd to County Hwy 33 in the Town of Kortright for a report of a personal injury auto accident. The driver, 58 year old Dominick Forte of Harpersfield was transported by Life Net Helicopter to Albany Medical Center for treatment of his injuries. Deputies arrested Forte for Aggravated Unlicensed Operation, DWI, Aggravated DWI, Speed unreasonable and prudent, failure to keep right, no seat belt and unlicensed operator. Forte was released on his own recognizance and will appear in the Town of Kortright Court at a later date.

State Police were dispatched to 741 Hawleyton Road in the town of Binghamton for a report of a fatal accident involving construction equipment operated on private property. The deceased was identified as 56 year-old Anthony Gawlinski, he was removed to Wilson Hospital for an autopsy, The Investigation is continuing
State DOT announced the start of work on the $1.9 million replacement of the State Route 7 Bridge over Kelsey Brook in the Village of Afton. The bridge will be strengthened and elevated two feet to better protect it against flooding. The new bridge will have a larger opening for the waterway below, making it less susceptible to flooding. Construction will be completed in two stages; the first stage calls for traffic to be controlled by temporary signals when a lane of the roadway is closed. The winter traffic pattern is scheduled for November 1, 2018, to April 15, 2019. The second stage of construction calls for temporary traffic signals when the roadway is reduced to a single travel lane through October 31, 2019.
State Senator Jim Seward announced senate passage of legislation to preserve voter choice in Otsego County. Seward's bill was developed following a minor administrative oversight where Otsego County Board District 10 Representative Dan Wilber inadvertently overlooked the requirement to sign his oath of office within 30 days of his swearing-in triggering an automatic vacancy. While he has been legally reappointed to the position by the county board, his office will be open for election again this November to fill the final year of the term. The new bill, if signed in to law, would allow Wilber to complete the two-year term he was elected to serve. The bill has been forwarded to the state assembly.
36-year-old Mike Rivera, Jr. of Binghamton pleaded guilty in Broome County Court for the December attack of a woman in Binghamton. Rivera pleaded guilty to 2nd degree Attempted murder, Attempted assault, 2nd degree Assault, Strangulation, Sexual abuse, & Unlawful imprisonment, first degree, for stabbing the woman with a knife, strangling her, and subjecting her to unwanted sexual contact. Sentencing is scheduled for August 31st.
47 year old Timothy Lee of Vestal has been arrested by the Binghamton Police Department for 2 counts each of criminal sex act and endangering the welfare of a child. Lee is accused of performing sexual acts with a 15 year student, while serving as a teacher in the Binghamton City School District; he was released in his own recognizance pending additional court action.

The new investment will include state and federal funding and leverage additional private sector capital, to rebuild the state's infrastructure, with investments in roads and bridges, mass transit, affordable housing, state colleges and universities, clean water infrastructure, health care infrastructure, State Parks and various other projects.

2 Otsego County Jail inmates were arrested by the Otsego County Sheriff’s Department. 39 year old Nancy Callahan of Richfield Springs was arrested after an investigation allegedly found her to be in possession of crack cocaine while incarcerated at the jail. She was charged with promoting prison contraband, & criminal possession of controlled substance, she remains incarcerated on a $10,000 cash bail. 32 year old Mark Russitano of Utica was arrested Monday, May 7 following an investigation into an alleged physical altercation against another inmate at the Correctional Facility. He was charged with attempted assault and remains incarcerated without bail.

State Police responded to a report of an assault Friday in the Town of Lisle, where the victim suffered a serious injury. Troopers said that the alleged assailant is 26 year old Thomas Sessions of the Whitney Point. Sessions is described to as 6 feet tall, approximately 240 pounds with blonde hair and blue eyes; he was left the scene in a white pick-up truck with oversized tires and a loud muffler. Anyone with information on the whereabouts of Thomas Sessions is requested to contact the State Police at 775-1241, email at Crimetip@troopers.ny.gov or by the State Police Facebook site.
State Police stopped a woman who disrupted a press conference at a State Police Substation at the Capitol in Albany yesterday with Governor Cuomo. The woman shouted obscenities & threw papers at the Governor; she was whisked away by troopers, while the Governor finished talking with reporters. The name of the woman was not released & no charges are being filed.
Attorney General Eric Schneiderman today a report today regarding Data Breaches in New York State in 2017. Companies reported 1,583 data breaches to Attorney General’s office, exposing the personal records of 9.2 million New Yorkers; quadruple the number of New Yorkers impacted in 2016. The Attorney General's Office suggests that consumers create Strong Passwords for Online Accounts and Update them frequently & to Change user names and passwords immediately on affected accounts. For breaches involving credit card numbers, social security numbers, Identity Theft Reports can be filed by calling the Federal Trade Commission at 1-877-438-4338
State Senator Jim Seward is calling on the state to investigate the impact Lyme and tick-borne diseases may have on mental health. The State Senate unanimously passed legislation that would require the state to study the link between infectious diseases, blood-borne pathogens and mental illnesses. The bill has been sent to the assembly for consideration.
The State Department of Environmental Conservation announced that trout fishing season opens Sunday. Attorney General Eric Schneiderman today a report today regarding Data Breaches in New York State in 2017. Companies reported 1,583 data breaches to Attorney General’s office, exposing the personal records of 9.2 million New Yorkers; quadruple the number of New Yorkers impacted in 2016. The Attorney General's Office suggests that consumers create Strong Passwords for Online Accounts and Update them frequently & to Change user names and passwords immediately on affected accounts. State Senator Jim Seward is calling on the state to investigate the impact Lyme and tick-borne diseases may have on mental health. The State Senate unanimously passed legislation that would require the state to study the link between infectious diseases, blood-borne pathogens and mental illnesses. Former Delaware County Sheriff's deputy Ted Tiska of Masonville was sentenced on Monday in Delaware County Court to 5 years in state prison for assaulting his wife with a meat cleaver in 2016. Tiska pleaded guilty to 2nd-degree assault in a plea bargain deal, He will also serve a term of 1½ years probation after his release.
State Police arrested 22 year old Kody Kemp of Friendsville Pennsylvania for Criminal Possession of a Weapon & Criminal Possession of a Controlled Substance & 30 year old Scott Maxey of Montrose Pennsylvania for Criminal Possession of a Weapon, after Troopers observed their vehicle traveling at a high rate of speed on Colesville Road in the town of Kirkwood. Troopers located a loaded gun in the vehicle and drug paraphernalia. Both were remanded to the Broome County Jail pending future court action.
Otsego County has received more than $842,000 in grants for improvements to emergency and public safety communications infrastructure and equipment. The $684,650 award will be used to complete 3 tower sites needed to complete the emergency services telecommunications project, the 2nd grant totaling over $157,000 will add a dispatcher position, and an alarm systems at tower sites.

Delaware County Sheriff’s Deputies arrested a 17 year old youth of Hamden, New York on charges of Driving While Ability Impaired by Drugs and Unlawful Possession of Marihuana. The Broome County Special Investigations Unit Task Force executed search warrants in Endicott & Vestal, following a traffic stop in Endicott, 4 Broome County residents & 2 from Kentucky have been arrested on Drug charges, police seized crystal meth, crack cocaine, morphine, oxycodone, $24,000 in cash form suspected drug sales, 2 loaded handguns, including 1 stolen from Kentucky, plus drug packaging, digital scales, plastic packaging and drug paraphernalia. All 6 were arraigned, 5 were remanded to the Broome County jail pending future court action.
Binghamton Firefighters responded to 3 fires in unoccupied buildings last night at 8 Livingston Street, & 23 Tudor Street & Susquehanna Street within a 6 hour period. The 3 fires follow another fire at an unoccupied apartment building at 38 Columbus Park East on March 1st, all 4 fires are labelled suspicious & the investigations are ongoing.

The DCMO Robert W. Harrold BOCES Campus in Masonville was evacuated at the end of the school day today, after a threatening note was found in a boy’s bathroom, according to Superintendent for Instructional Service Michael McDonald. The Delaware County Sheriff's Department & the State Police Bomb Sniffing K9 unit responded, McDonald told WCDO News that more information will be released later on their website DCMOBOCES.com
Governor Cuomo updated the status of storm recovery operations in the Hudson Valley as a second winter storm is being forecast to impact New York. Last week's storm caused extensive damage to electric utility infrastructure, including hundreds of broken utility poles and damage in remote locations, however power outages have continued to steadily decrease. Thousands were still without power in the Hudson Valley, about 800 were without power in Delaware County early this morning.
The lock-down on the Utica College campus was lifted late Monday Afternoon, with Residential students returning to their dorms, & Commuter students, faculty and staff were allowed to leave the campus last night. Law enforcement remained on campus last night as they continued the investigation, following the school receiving a report of a gunman on campus, which officials deemed as "Not Credible". Classes were back in session today, so far, no arrests have been made.
State Police arrested 42 year old Kenneth Barrows of Binghamton for Criminal Obstruction of Breathing and Assault, after Troopers responded to the Upper Delaware Inn, in Hancock after Barrows allegedly struck & choked a woman. Barrows was remanded to the Delaware County Jail on $2,500 bail or $5,000 bond.

State Police arrested 37 year old Lisa Keyes of Fenton for Aggravated DWI with a B.A.C. result of .21%, plus Reckless Endangerment and multiple traffic violations. Troopers arrested Keyes after she led Broome County Sheriff’s Deputies in a pursuit where she was observed traveling in the wrong direction on I-88, I-81 and State Route 17. Troopers went ahead of Keyes on Route 17 in the town of Union where she finally stopped. Keyes was released and is scheduled to appear in the town of Union Court on April 3rd.
State Police arrested 29 year old Astrid Paulis of Worcester for Aggravated DWI with a B.A.C. result of .22% and other traffic offenses. A motorist on State Route 23 in the town of Davenport contacted 911 after they observed a 1-car motor vehicle accident. Troopers located Paulis at her residence, she was released on tickets for town of Davenport Court on March 27th.
Delaware County Sheriff Deputies observed a vehicle recently in Walton, at 52 miles an hour in a posted 30 mile an hour zone. Deputies arrested 19 year old Joseph Butler of Cortland Manor, deputies seized a large amount of marijuana, Butler was charged with Speeding & Criminal Possession of Marijuana, he was arraigned in the Village of Walton Court & was remanded to the Delaware County Correctional facility in lieu of $2,500 cash bash, pending future court action. Deputies were assisted by Walton Police.

The DCMO Robert W. Harrold BOCES Campus in Masonville was evacuated at the end of the school day today, after a threatening note was found in a boy’s bathroom, according to Superintendent for Instructional Service Michael McDonald. The Delaware County Sheriff's Department & the State Police Bomb Sniffing K9 unit responded, McDonald told WCDO News that more information will be released later on their website DCMOBOCES.com
Governor Cuomo updated the status of storm recovery operations in the Hudson Valley as a second winter storm is being forecast to impact New York. Last week's storm caused extensive damage to electric utility infrastructure, including hundreds of broken utility poles and damage in remote locations, however power outages have continued to steadily decrease. Thousands were still without power in the Hudson Valley, about 800 were without power in Delaware County early this morning.
The lock-down on the Utica College campus was lifted late Monday Afternoon, with Residential students returning to their dorms, & Commuter students, faculty and staff were allowed to leave the campus last night. Law enforcement remained on campus last night as they continued the investigation, following the school receiving a report of a gunman on campus, which officials deemed as "Not Credible". Classes were back in session today, so far, no arrests have been made.
State Police arrested 42 year old Kenneth Barrows of Binghamton for Criminal Obstruction of Breathing and Assault, after Troopers responded to the Upper Delaware Inn, in Hancock after Barrows allegedly struck & choked a woman. Barrows was remanded to the Delaware County Jail on $2,500 bail or $5,000 bond.

State Police arrested 37 year old Lisa Keyes of Fenton for Aggravated DWI with a B.A.C. result of .21%, plus Reckless Endangerment and multiple traffic violations. Troopers arrested Keyes after she led Broome County Sheriff’s Deputies in a pursuit where she was observed traveling in the wrong direction on I-88, I-81 and State Route 17. Troopers went ahead of Keyes on Route 17 in the town of Union where she finally stopped. Keyes was released and is scheduled to appear in the town of Union Court on April 3rd.
State Police arrested 29 year old Astrid Paulis of Worcester for Aggravated DWI with a B.A.C. result of .22% and other traffic offenses. A motorist on State Route 23 in the town of Davenport contacted 911 after they observed a 1-car motor vehicle accident. Troopers located Paulis at her residence, she was released on tickets for town of Davenport Court on March 27th.
Delaware County Sheriff Deputies observed a vehicle recently in Walton, at 52 miles an hour in a posted 30 mile an hour zone. Deputies arrested 19 year old Joseph Butler of Cortland Manor, deputies seized a large amount of marijuana, Butler was charged with Speeding & Criminal Possession of Marijuana, he was arraigned in the Village of Walton Court & was remanded to the Delaware County Correctional facility in lieu of $2,500 cash bash, pending future court action. Deputies were assisted by Walton Police.

Delaware County Sheriff's Deputies investigated a complaint at the Charlotte Valley School Thursday, relating to a threat made by an elementary student at dismissal time that day. Deputies issued a juvenile appearance ticket to an unidentified 8-year-old Davenport youth, who allegedly threatened to burn down the School, the student was charged with making a terroristic threat, & will appear at the Delaware County Probation Department at a later date to answer that charge.
New York State Police and the Utica Police Department are investigating a threat at Utica College earlier today. Staff and students at Utica College received an alert at about 11:00 AM today, that the campus was on lockdown because of the threat, everyone was ordered to stay where they were while the threat was investigated. There is no confirmation of any shots fired on campus, and there are no injuries reported. Law enforcement continues to investigate threat. Local, state, and federal law enforcement are on scene.
State Police arrested 26-year-old Christopher Neumann of Castleton in connection with a collision that injured 2 troopers & 2 tow truck operators early Sunday on Interstate 90. Troopers Brent Karow and Shane Swartz were investigating an unrelated 1-car crash on I-90 in North Greenbush at approximately 5:15 a.m. Sunday, when Neumann's vehicle struck their patrol car, which then hit both troopers and tow truck operator, Jeffrey Waite. Trooper Karow was thrown 70 feet into the median, while Trooper Swartz and Waite were thrown under the tow truck, all 3 were taken to Albany Medical Center, a 2nd Tow Truck employee was hit by flying debris & was treated at the scene. Neumann was charged with 1st degree vehicular assault, DWI and numerous other traffic violations, he was arraigned & was remanded to the Rensselaer County Jail.

Governor Cuomo announced that the state has moved its fall primary election date back 2 days so it doesn’t interfere with the anniversary of 9/11 or a Jewish holiday. Cuomo signed the law Friday to move the primary to Thursday, September 13th.
The State University of New York has established a task force to focus on food security issues at its 64 campuses. The SUNY system reported that 70% of its campuses have a food pantry for students or partnerships with community organizations that provide meals. SUNY Chancellor Kristina Johnson said the goal is for all campuses to have food pantries or arrangements with community groups that provide resources for food.
Congresswoman Claudia Tenney announced her re-election campaign Saturday; she is running against Democratic State Assemblyman Anthony Brindisi of Utica for the 22nd Congressional District. Tenney was elected to the seat in 2016, replacing retiring Congressman Richard Hanna.
NYSEG made progress following the significant winter storm on Thursday. The storm resulted in more than 188,000 outages, as of Sunday morning, 117,000 customers had power restored. The company expects more than 90% of customers affected by the storm in the Catskills region to restored by 11:45 pm tonight.
State Police arrested 49 year old Harvey Scott of Oneonta for Petty Larceny, after Scott allegedly walked out of the Oneonta Walmart with a cart full of items totaling $676. Harvey was remanded to the Ostego County Jail on $1,000 cash bond or $2,000 bail.

State Police advised that Christian Rojas-Martinez, age 22, of Bronx, NY was found deceased earlier today inside a body of water that was inside the area being search. An investigation as determined that since January 19, Christian was staying at a home and was camping with six other men at 521 Old Ferris Farm Road, in the town of Roxbury. On the evening of January 20, he wandered away from the location and did not return. He was reported missing by his companions on January 21, at about 12:45 a.m. The investigation is ongoing. State Police were assisted in the search by two NYSP K-9s, NYSP Aviation, NYS DEC, NYS Forest Rangers, Delaware County Sheriff’s Deputies, Delaware Emergency Management Agency, Town of Roxbury Constable, and fire department and EMS personnel from Roxbury, Grand Gorge, and Hobart.
The Chenango County Sheriff’s Office is investigating a fatal fire that occurred at about 4:50 am that claimed the lives of 3 people. Killed in the fire were 33 year old Debbie L Pfeiffer, 1 year old Benjamin Pfeiffer and 10 year old Amber Morrow. The cause of the fire is still being investigated and autopsies will conducted on the victims on 01/23/18 at Lourdes Hospital. The Sheriff’s Office was assisted at the scene by Chenango County Bureau of Fire, Plymouth Fie Department, North Norwich Fire Department, City of Norwich Fire Department, Smyrna Fire Department, Sherburne Fire Department and the New York State Office of Fire Prevention and Control. Jury selection began today in the corruption trial of Joseph Percoco, who was a top aide to Governor Andrew Cuomo. Percoco is charged with taking $300,000 worth of bribes from 2 companies working with the state. Prosecutors say he used his relationship with Cuomo to win those companies favorable treatment.

His next court date is pending.

Cal Harris of Owego had his license suspended in Preble town court yesterday, where he appeared to answer to a DWI charge from last month. An autopsy will be performed today on 18-year-old Destyni Twyman of Walton, after she suffered a medical emergency at Walton High School Tuesday, and was taken to Delaware Valley Hospital, where she later died. School officials announced that grief counselors are on hand for students & staff affected by Twyman's death, through the next few days.
