Governor Cuomo today announced that an investigation by the Department of Public Service’s Consumer Advocate has resulted in 1,566 utility consumers receiving $950,700 in energy bill refunds from Ambit Energy, following customer complaints filed against the company. The investigation was launched after the Department of Public Service raised concerns over Ambit’s customer disclosure statements and renewal notices, particularly for customers who were moved from a guaranteed-savings plan into a variable rate plan charging significantly more. Ambit has made major adjustments to customers’ bills in an effort to both resolve concerns raised by the Department and satisfy customers who were charged more after being moved out of the guaranteed-savings plan.
The Broome County Sheriff's Office have charged a man with DWI, following an accident involving 3 tractor trailers Monday morning. The accident occurred on Colesville Road in Kirkwood, where a tractor trailer driven by 54 year old Daniel Masonic of Binghamton, crossed over the double yellow lines and struck two other tractor trailers who were headed the opposite direction. Masonic's truck then went off the road, up an embankment, and struck a group of trees. Masonic's BAC was .18%. He was issued tickets to appear at a later date in the Town of Kirkwood court.
The Binghamton Mets have formally announced a new owner; Buffalo area businessman John Hughes & his group are the new owners of the team.

Hughes is the head of Evans Street Baseball, Incorporated, they will honor the player development contract with New York Mets through 2020, and the NYSEG stadium lease through 2022. General Manager Jim Weed and staff have been retained.
The American Red Cross encourages eligible donors to donate blood today. Appointments can be made with the free Red Cross Blood Donor App, at redcrossblood.org or 1-800-RED CROSS. A Blood drive will be held in West Oneonta today from 1:00 to 6:00 PM at the West Oneonta Fire Department.

The murder trial of 57-year-old John Guzy is scheduled to begin in late March in Chenango County Court. Guzy is accused of fatally shooting 26 year old Derek Prindle of Afton, and shooting in injuring Prindle’s father, 60 year old Derek Prindle, in a case of alleged road rage on October 27th 2014, on state route 7 in Bainbridge. Guzy turned himself in to state police at the Troop C headquarters after the shooting; he remains held at the Chenango county jail pending the upcoming trial.
Empire State Development Announced that Amphenol Corporation in Sidney will receive $750,000 for propane to their Sidney factory while they wait for a natural gas pipeline to be built through the southern tier. The ESD Board approved of the Monday to divert up to $750,000 in an existing incentive package that allowed Amphenol to stay in Sidney after the 2 serious floods in 2006 & 2011. Amphenol operates a new closer to the I-88 Corridor, where they will be able to acquire natural gas service from the planned Constitution Pipeline.
Governor Cuomo signed a bill into law that will help prevent future home fire deaths in New York State. The bill provides that batteries in battery operated single station smoke detecting alarm devices shall be non-replaceable, non-removable and capable of powering the devices for a minimum of ten years. The bill was proposed as Firefighters frequently encounter homes without smoke alarms or working smoke alarms, where residents fail to replace old batteries. The law goes into effect in 2017.
State Troopers arrested 34 year old Nathaniel Dendler of Windsor for DWI, Aggravated Unlicensed Operation of a Motor Vehicle, Inadequate Exhaust and Criminal Possession of a Controlled Substance. Dendler's passenger, 19 year old Caleb Harris of Windsor was found to be in possession of heroin and suboxone and was charged with Criminal Possession of a Controlled Substance. Both arraigned in the Town of Windsor Court, Dendler was remanded to the Broome County Jail in lieu of $2,000 cash bail. Harris was released on his own recognizance.
Binghamton Police arrested 41 year old Harry Johnson for 3rd degree Grand Larceny & Falsely Reporting an incident. Johnson is accused of reporting an armed robbery at Joseph Guardi Auto Sales in Binghamton, as he opened up the business Saturday morning. Detectives determined that a robbery did not happen, Johnson was arraigned and is being held in Broome County Jail.

A jury was seated in a federal courtroom in White Plains Monday in the trial of State Senator Tom Libous of Binghamton. Libous is accused of lying to the FBI about using his political influence in getting his son Matthew at a Westchester law firm. Matthew Libous faces prison time for tax evasion. Tom Libous still holds a seat in the New York State Senate.
Sidney village police department is asking for any information regarding the vandalism at the Sidney Pool Saturday night. Anyone with information can contact the Sidney police at 561-2301.
Federal officials have scheduled hearings on the 2nd natural gas pipeline proposal through the Southern Tier. The sessions hosted by the Federal Energy Regulatory Commission will begin at 7:00 PM Thursday at the Foothills Performing Arts Center in Oneonta, & at the Days Inn in Schoharie. Kinder Morgan proposes constructing a pipeline along the same corridor as the recently approved Constitution Pipeline, to move gas from Pennsylvania into New England. The Kinder Morgan Pipeline still needs approval from FERC.
The Chenango county health department has scheduled a free rabies clinic tonight in Coventry. The clinic will be held from 5:30 to 6:30 at the Coventry Highway department, for dogs, cats & domesticated Ferrets.

State Police at Oneonta arrested 46 year old Nicholas Mihalik of Davenport for 3rd degree Assault. The arrest resulted from a complaint at a residence in the Town of Kortright, Mihalik was arraigned and remanded to the Delaware County Jail on bail.
Delaware County Public Health will hold a Free Rabies Vaccination Clinic For dogs, cats, and ferrets today. The clinic will run from 5:00 to 6:30 PM in the Colchester Highway Garage in Downsville.

State Police at Oneonta arrested 28-year-old Andrew Scheiner of Worcester Sunday, for Aggravated DWI with a B.A.C. result of .22%. Scheiner was charged after Troopers responded to an Otsego County 911 report of a vehicle being driven the wrong way on Interstate 88 eastbound in the Town of Oneonta, just prior to their arrival Scheiner, struck the side of a bus at mile marker 59. No one was injured, the investigation determined that he was intoxicated and had a suspended driver license. Scheiner was arraigned at the Town of Oneonta Court and remanded to the Otsego County Jail in lieu of $1,000 cash bail or $2,000 property bond. His next court date is on July 16th.
The Broome County Sheriff's department arrested 2 men in the Town of Lisle for manufacturing methamphetamines. Deputies arrested 28-year-old Anthony Scott of Lisle & 37 year old Marcus Vanvorce of Berkshire both are accused of possessing over the county decongestants & other materials used to manufacture math. Both are being held in Broome County Jail without bail.
The number of counties overriding New York’s property tax cap has declined by more than half over the past four fiscal years, dropping from 15 in 2012 to only 6 this year, according to a report issued today by State Comptroller Tom DiNapoli. The report also noted that the counties’ average tax levy increase has remained at or below 2 percent in each of the past four years. DiNapoli’s report revealed the property tax levy collected by the 57 counties outside of New York City increased 5.3%. 27 counties have exceeded the tax cap at least one time. Delaware County exceeded the cap in each of the 4 years and 5 counties exceeded the cap in 3 out of the 4 years.
State Senator Jim Seward today announced his opposition to plans to site a 2nd gas pipeline through portions of his district. Seward said that the proposal submitted by Tennessee Gas Pipeline should be rejected, as the area is already under FERC approval by the Constitution Pipeline, which is slated to will supply natural gas to Amphenol, the Village of Sidney, and other local interests. No such plan exists with the Tennessee Gas Pipeline proposal from Kinder Morgan. Seward also echoed a demand made by the Delaware County Board of Supervisors that, should the project be approved, a formal agreement be executed to ensure that all local costs attributable to pipeline construction, be paid for by Kinder Morgan.

A new Quinnipiac University poll has Governor Cuomo's approval rating to 44%, with 42% disapproval. A poll in March had the governor at 50% approval & 39% disapproval. 45% of those polled think all state lawmakers should be voted out of office.
Top level new York state leaders have been frequently arrested for a variety of crimes over the last several years, the most recent being Sheldon Silver & Dean Skelos resigning from leadership posts in the state legislature. Area Assemblyman Cliff crouch said that lawmakers have been getting ethics training over the last few years.

Crouch said that he believes that new leaders Carl Heastie & John Flanagan will do a fine job & will be scrutinized intensely. Crouch said that the spate of arrests of top-level state leaders since he’s been in Albany shows the need for term limits in all leadership positions, including in committee chairmanships..
Governor Cuomo renewed his push for lawmakers to extend a cap on local property taxes. The governor announced that they would launch an online media campaign to support the cap that was enacted in 2011. Republicans in both houses want the cap made permanent, while Cuomo seeks only a 5-year extension of the existing law. The cap generally restricts local governments from increasing tax levies by more than 2 percent or the rate of inflation and can only be overridden by voters.
Constitution Pipeline Company announced the recipients of the 6th cycle of their Community Grant program, awarding 25 grants totaling more than $200,000 to benefit local communities within the counties traversed by the proposed pipeline project. Current grants were awarded to the Town of Afton, The Village of Bainbridge, The Bainbridge Historical Society, the Chenango County Blues Association, the Franklin Fire Department, the Delaware County Fire Fighters Association, the Delaware County Sheriff's Office & the Alcohol and Drug Abuse Council of Delaware County.
State Police arrested 66-year-old Christine Welborn of Norwich, for Aggravated Driving While Intoxicated with a B.A.C. of .19%. The arrest occurred after a traffic stop for failing to keep right on State Route 206 in the Town of Bainbridge. Welborn was issued tickets returnable to the Town of Bainbridge Court on June 11th.

Broome County Fire officials reported that 4 people died early this morning in a house fire at 439 State Line Road in the town of Vestal. Fire officials said that a mother & 3 of her children were killed in that fire, one 15 year child escaped, and the father of the children was at work. the fire was called in at about 2:00 AM this morning, 5 area fire departments responded, more details will be released at the conclusion of the investigation as well as family notification..
Governor Cuomo announced that road and bridge construction projects on State highways will be suspended from 6:00 AM Friday, to 6:00 AM Tuesday, in order to accommodate travelers during the busy Memorial Day holiday weekend. Some work may continue behind permanent concrete barriers or for emergency repairs. AAA predicts that of the more than 37 million people traveling more than 50 miles from home this weekend, an estimated 33 million of them will be traveling by car. This Memorial Day weekend is expected to have the highest travel volume of the past ten years. Travelers can call 511 or by access 511ny.org for details.
Landowners & businesses along the I-88 corridor are now attending a second round of public meetings for a second pipeline proposal from Kinder Morgan, after the region already attended meeting for the Constitutition pipeline along the same pathway. Area Assemblyman Pete Lopez comments:

The plans call for the Constitution Pipeline to provide access along the way to businesses & municiaplities, including Amphenol in Sidney, the Kinder Morgan pipeline initially calls for no such local offerings.
Governor Cuomo announced that New Yorkers can now contact the New York State HOPEline addiction referral and support service by texting 1-877-8-HOPENY. The HOPEline is a free and confidential 24-hour service that connects people who are struggling with substance abuse and problem gambling to trained professionals for assistance in times of need. The New York State Office of Alcoholism and Substance Abuse Services has contracted with the Mental Health Association of New York to expand existing HOPEline services to include the texting feature.
On Saturday, June 6th at 1:00 pm until 4:00 pm, Scoville-Meno in Sidney will partner with parents & teachers at parking lot of Unadilla Elementary School for a “Drive for the Kids” fundraiser, to raise money during the Playground Celebration. Parents and guests can earn a $10 contribution for the school from the Chrysler brand, by taking a test drive in a new 2015 Chrysler vehicle from Scoville-Meno. The State DMV has seen a significant increase in the number of motorcycle permit holders who participate in motorcycle safety courses. DMV Deputy Commissioner Terri Egan announced that in 2014, 70% of motorcycle permits holders in New York State elected to take motorcycle safety courses, up from 51% in 2010. There are between 36,000 and 44,000 permit riders in a given year in New York State, which allows them to ride on the road under the guidance of a licensed motorcycle operator.

The State DEC today announced a new 15-day public comment period on the re-submitted Water Quality Certificate application for the proposed, federally regulated Constitution Pipeline. Public comments on the proposed project will now be accepted until close of business on Thursday, May 14. Those who submitted comments during the first comment period which ended February 27, 2015 do not need to resubmit their comments. A City of Cortland resident was arrested by the Chenango County Sheriff’s Office for DWI and other traffic offenses. 27 year old Libny Torres was charged with DWI & unsafe lane change following an investigation into a motor vehicle accident on I-88 in the Town of Afton. TORRES allegedly fell asleep at the wheel prior to veering off the roadway and into a guide rail. Torres was arraigned in the Town of Afton court and is being held ON $5,000 cash bail & is scheduled to reappear in the Town of Afton Court at a later date.
Delaware County Public Health is holding a “Medical Countermeasures” drill on Today, to practice and test the ability to dispense large amounts of medicine in the event of a public health threat such as a disease outbreak or bioterrorism threat to the community.All are welcome to attend the drill. Governor Cuomo will lead the first official state trade mission to Cuba since President Obama began the process to normalize diplomatic relations between the United States and Cuba. The upcoming trade mission will allow New York State officials and business leaders to explore opportunities and advance shared interests, the delegation will leave for Cuba on April 20th.
A Siena College poll released this week shows that 92% of polled New Yorkers believe that corruption in state government is a serious problem. 51% believe it's very serious, & believe that more needs to be done to stop Albany Corruption. Governor Cuomo's own ethics push includes new disclosure requirements for lawmakers as well as requiring receipts for travel expenses. Cuomo is attaching the measures to spending in the budget and said he's fine with risking an on-time budget to get ethics done. However, 53% prefer an on time budget to ethics reforms getting done immediately, while 37% want ethics reforms tackled first, even if it means a late state budget in April.
School officials, education leaders, and state lawmakers are not happy with Governor Cuomo tying the issue of lawmaker’s ethics reforms to the state budget, and subsequently, state aid projections for school districts. Area Assemblyman Cliff crouch comments:

Plans call for the construction of the natural gas pipeline to begin this summer, it would pass through Broome, Delaware & Schoharie counties locally from Pennsylvania to the Northeast states.
Governor Cuomo outlined his proposal to expand pre-K to 3-year olds in the State's highest-need communities. The Governor is committing $25 million to fund this pilot program, for which more than 250 school districts will be eligible to apply. More than 5,000 seats are projected to be made available for 3-year olds across the State through this program. The State currently spends more than $750 million annually on pre-K for 4-year olds, supporting the education of 116,000 children.
Attorney General Eric Schneiderman announced today that he would propose legislation in Albany to protect and reward employees who report information about illegal activity in the banking, insurance, and financial services industries. Currently, no law exists in New York State to protect or incentivize whistleblowers who report securities and other financial frauds. Schneiderman’s bill would provide financial compensation to whistleblowers whose tips lead to more than $1 million in penalties or settlement proceeds, it would also guarantee the confidentiality of the whistleblower’s information, and make it illegal for any employer to retaliate.

Delaware County Sheriff's Deputies identified the person and vehicle sought in a Sands Creek Road, Town of Tompkins burglary investigation. 32-year-old Justin Biedekapp of Hancock, confessed to the crime to authorities after surveillance photos & information were released to the media. Biedekapp was charged with 2nd degree Criminal Trespass & was issued an appearance ticket returnable in the Town of Tompkins Court at a later date.
Governor Cuomo presented the second part of his "2015 Opportunity Agenda" Thursday at a presentation in Rochester, to discuss the $1.5 billion Upstate New York Economic Revitalization Competition to restore economic opportunity to the Upstate regions.

The proposed competition uses the Buffalo Billion’s proven model, Projects exhibiting region-wide impact will be made a priority and should focus on strengthening critical infrastructure, revitalizing communities, bolstering workforce development, growing tourism, and improving quality of life. 7 regions are eligible to compete for 1 of 3 $500 million upstate revitalization funds.
Governor Cuomo recently asked the Gaming Casino Location Siting Board to consider awarding the 4th casino license to the Southern Tier Region, after awarding only 3 licenses out of 4 last month. Area State Senator John Bonacic stated that the Sullivan County choice in his district is outstanding, and should be fast-tracked to get open quickly, before considering Tioga downs:

Bonacic said that the casino in Sullivan County is projected to being over 20 million dollars a year in extra revenue to the Sullivan & Orange County areas due to the expected increased tourism to the area because of the new casino.
Nigel Saunders was found guilty of 2 counts of 2nd degree murder, 1st degree burglary 1st degree robbery and 2nd degree assault in Broome County court this morning. Saunders was on trial for the murder of 23-year-old Jordan Dordell & his fiancé in Binghamton, after only 3 hours of deliberation. Saunders will be sentenced on March 27th.
The state Department of Health inappropriately paid more than 29,000 pharmacy claims worth nearly $1 million over a 27-month period for thousands of Medicaid recipients whose benefits were already covered by other plans, according to an audit released today by State Comptroller Tom DiNapoli. A second audit released today found another $61,711 in overpayments to providers because of incorrect Medicare coinsurance, copayment or deductible amounts. DiNapoli recommended that the DOH Review and recover improper overpayments; instruct providers to bill Medicare Part C claims in accordance with existing requirements, & assess all claims that auditors did not examine in detail and determine if overpayments were made that warrant recovery.
The National Baseball Hall of Fame and Museum in Cooperstown announced today that an Arizona Diamondbacks logo will appear on the cap of the Hall of Fame plaque for 2015 Hall of Fame electee Randy Johnson. The cap selections for Pedro Martinez and John Smoltz will be announced on January 22nd Craig Biggio played his entire career with the Houston Astros. This year’s Hall of Fame Class will be inducted into the National Baseball Hall of Fame on Sunday, July 26th in Cooperstown.
The Chenango County Sheriff's Department arrested 19-year-old Maxwell Horton of Sherburne for unlawful possession of marihuana. Deputies arrested Horton following a traffic stop for vehicle and traffic violations and during the investigation of the traffic stop deputies found Horton to be in possession of marihuana. Horton was released on an appearance ticket for Village of Sherburne court on a later date.

The Constitution Pipeline will be the topic of the 3rd DEC hearing this week, tonight at 6:00 pm at the SUNY Cobleskill Bouck Hall Theater. The pipeline would run form northeast Pennsylvania through the southern tier to Schoharie County to deliver natural gas into the northeast if approved.
Attorney General Eric Schneiderman joined Facebook in announcing a new system to help find missing children by changing the way Amber Alerts are delivered. In partnership with the National Center for Missing and Exploited Children, Facebook’s new distribution system will send Amber Alerts to the news feed of Facebook users if they are in the targeted search area after a child has been abducted. according to Schneiderman, More than 180 Amber Alerts are sent out each year, the chances of finding a missing child increase when more people are on the lookout – especially in the first few hours,
The Cancer Services Program of Delaware, Otsego and Schoharie counties will offer free health screenings in Delhi today to women 40 and older who are uninsured. Governor Cuomo will combine both his State of the State address and the release of his executive budget into one presentation next week on January 21st. The address and release of the 2015-16 executive budget will be presented to a joint session of the legislature on January 21st at 1:30 PM in the Empire State Plaza Convention Center in Albany. Governor Cuomo originally planned to give his State of the State address on January 7th, that was pushed back due to the death of his father, former Governor Mario Cuomo
State Police at Oneonta arrested 23-year-old Jordon Davis of Laurens for the Fleeing an Officer, Reckless Driving, Unlawful Possession of Marihuana and several vehicle and traffic law violations. The arrest occurred after Troopers observed Davis failing to keep right on State Route 205 in Oneonta, when the Troopers activated their emergency lights and sirens, Davis accelerated to over 100 miles an hour and failed to comply with the officers. Troopers located the vehicle parked behind a residence off of State Route 205. Davis was arraigned at the Town of Oneonta Court and released without bail required; he faces court action February 12th.
The State DEC extended the public comment period on the draft permit for the proposed, federally regulated Constitution Pipeline, as well as the upgrade to the Iroquois Wright Compressor station in Schoharie County, by an additional 28 days. Public comments on the proposed project will be accepted through Friday, February 27th at 5:00PM. The Federal Energy Regulatory Commission was responsible for conducting an environmental review of the project; they issued a final Environmental Impact Statement in October. People can provide verbal or written comments at the public meetings tonight at 6:00 PM in Oneonta at SUNY Oneonta Lecture Hall IRC #3, or Wednesday night at 6:00 PM in SUNY Cobleskill’s Bouck Hall Theater.
State Attorney General Eric Schneiderman announced the arrest of James Ferro the former director of the Department of Corrections and Community Supervision’s Special Investigations Unit, over accusations of sexually based harassment of a subordinate employee. Ferro faces 1 count each of Forcible Touching, Official Misconduct, Coercion & Harassment. Ferro is accused of inappropriately touching a subordinate and Community Supervision, at the Department of CorrectionalS in Albany over the course of several years.
Governor Cuomo today announced new efforts to combat human trafficking and provide help to survivors safely re-enter their home community. This crime affects more than 1,000 children in New York each year, and it is estimated that nearly 18,000 people are brought into the United States annually for the same purpose. The Governor also proclaimed January as Human Trafficking Awareness Month, and unveiled a new poster that lists possible trafficking red flags, plus a free confidential hotline, which is 1-888-373-7888.
Former New York Governor George Pataki is considering a run for the White House; he campaigned in New Hampshire recently, where one of the earlier primary votes are held. Pataki left office in 2007 after serving three terms as governor of New York.
