Public Comments Sought On Draft State Permit Applications For the Proposed Constitution Pipeline Will Be Accepted now through January 30th, 3 Public Meetings to be held in January. The Chenango County Sheriffs department arrested 60-year-old Richard Graef of Columbus for Harassment, obstruction of governmental administration, and resisting arrest. Graef was charged following a traffic stop in the Town of Columbus for a moving violation, he exited the vehicle, began threatening the deputy and subjected the deputy to unwanted physical contact, interfered with the official duties while the deputy was conducting the traffic stop, and then resisted arrest while being placed into custody. Graef was arraigned in the Town of Columbus Court and was remanded to the Chenango County Correctional Facility in lieu of cash bail. Graef is scheduled to reappear in the Town of Columbus Court at a later date.
The Chenango County Sheriffs department arrested 38-year-old Richard Small of Cortland for Promoting Prison Contraband. Small is accused of attempting to hide narcotic prescription medications on his person while remanded to the Chenango County Correctional Facility. Small was processed and will appear in the Town of Norwich Court at a later date.
State Attorney General Eric Schneiderman and Massachusetts Attorney General Martha Coakley led a coalition of 17 states to file a brief in the U.S. Supreme Court urging them to uphold the interpretation of the federal Fair Housing Act. The Inclusive Communities Project had proven a low-income housing tax credits program resulted in a disparate impact on African-American residents in violation of the Fair Housing Act. The Supreme Court is scheduled to hear arguments in the case on Wednesday, January 21, 2015.

New Yorkers oppose giving the state Legislature its first raise since 1999, and they remained split over whether the state should have moved forward with hydraulic fracturing, according to a Siena College poll. Voters oppose a legislative pay raise, 63 to 28%. Despite voters being evenly split upstate, the state's tough gun-control law called the SAFE Act was supported, 58 to 33% statewide. Voters were also evenly divided on the Dream Act that would provide tuition assistance to illegal immigrants, with 44% supporting it and 48% opposing it. Governor Cuomo had a 58% to 37% favorability rating, up slightly from October.
Action has been taken against several retailers after an investigation revealed many were selling toy guns that appear to be real. Attorney General Eric Schneiderman's office sent cease and desist letters to stop the online sales and shipments of toy guns that do not have required distinguishing designs. State law prohibits the sale of imitation guns in realistic colors, unless it has a one-inch wide orange stripe running down both sides of the barrel. Some toy guns could be mistaken for real weapons by both law enforcement and the general public. Since 1997, at least four people have died when law enforcement mistook toy guns for the real thing.
Governor Cuomo announced that the next phase of New York’s Combat Heroin campaign. Starting today, public service announcements will begin airing in movie theaters across New York State & 10 new “Real Story” videos have been posted to the state’s Combat Heroin website, at combatheroin.ny.gov. The PSAs and new videos show New Yorkers sharing their stories of recovery and addiction, the PSAs will be shown in movie theaters through early January, The Combat Heroin website now has 22 videos of New Yorkers describing heroin or prescription opioid addictions. combatheroin.ny.gov/real-stories.
The state DEC is reminding New Yorkers that as of January 1st, old electronic equipment must be recycled, not thrown in the trash. That includes computers, cell phones, televisions, stereos and other devices that plug in or run on batteries. On DEC's electronics recycling web page, consumers will find the brand of equipment they wish to recycle, as well as a link to the manufacturer's recycling program web page and a toll-free number for information about recycling. About three quarters of public high school students in New York graduated on time in June, though graduation rates in the state's largest cities remain far lower, according to data released by the state Education Department. A total of 76.4% of students who entered 9th grade in 2010 graduated with a diploma before June 2014, up slightly from the 74.9% who graduated within 4 years the previous year.
Governor Cuomo signed legislation opening the door for growing and researching industrial hemp in New York. The bill, introduced by Assemblywoman Donna Lupardo, creates an agriculture pilot program to study ways to cultivate and manufacture products with the multi-use crop. It passed both houses of the State Legislature in the spring. Colleges and universities, including Cornell, Binghamton University, may take part in New York's research program.

Governor Cuomo announced today that New York will not move forward with hydrofracking. The announcement follows a study on a possible health effects on Hydraulic Fratcuring for Natural gas. State Health Commissioner Dr. Howard Zucker doesn't recommend moving forward with hydrofracking until more studies are done, the state has hadf a moratorium in place for 6 years, ther process was used extensively in Western New York since 1979.
The state Gaming Facility Location Commission announced today, that the Southern Tier Casino License was awarded today to Lago in Tyre New York, in Seneca County. Plans call for a casino & hotel complex which has the backing of Wilmorite of Rochester, which has experience in casino operations. The casino site will be located off of exit 41 on the New York State thruway
The Chenango County Sheriff’s department arrested 25-year-old Anastatia Hallenbeck of Norwich Tuesday, following an investigation into the sales of heroin in the Norwich area. Hallenbeck was charged with 2 counts of Criminal Sale of a Controlled Substance, she was arraigned in the City of Norwich Court and remanded to the Chenango County Correctional Facility on $5,000 cash bail.

Intres is accused of subjecting a female victim to unwanted physical contact, knocking the victim to the ground & choking her, during a domestic dispute. Intres was arraigned in the Town of Plymouth Court & was remanded to the Chenango County Correctional facility on $2,500 cash bail; he faces court action in the Town of Plymouth Court at a later date.
Governor Cuomo today announced new regulations to include transgender health care services under New York State’s Medicaid program. The proposed regulations provide treatment for hormone therapy and gender reassignment surgery. Under the proposed regulations, hormone therapy and gender reassignment surgery would be covered for persons who have referrals from medical professionals. Surgery would be covered for individuals who are a minimum age of 18 or 21 years old, depending on specific circumstances. The public will have 45 days to comment on the proposed regulation.
Former Governor George Pataki is considering a run for the White House. Pataki said he plans to decide next year whether to seek the GOP nomination. Pataki was governor from 1995 to 2006; he then launched a consulting firm and joined a New York City law firm.
Governor Cuomo today announced that $26.8 million in State Funding is being awarded to 38 rail and aviation safety, security and Economic development projects across the State. $17.8 million in funding will go for rail upgrades, locally, the Syracuse, Binghamton and New York Railroad Corporation of Cooperstown received $262,600, New York, Susquehanna and Western Railroad of Cooperstown received $2.3 million for improving rails, ties and surfacing & the Central New York Railroad of Cooperstown received $3.1 million to rehabilitate railroad track in Delaware and Broome Counties.
The state Education Department released teacher evaluation scores. 95.6 percent of teachers were rated "effective" or "highly effective" during the 2013-14 academic year despite less than 40 percent of grade 3-8 students being graded "proficient" on their state-mandated tests the same year. 3.7 percent of New York teachers were deemed "developing" and just 0.7 percent were rated "ineffective." The teacher and principal evaluations are based 60 percent on classroom observations and measures agreed to by schools and local teachers unions. The remaining 40 percent is based on student test scores, including 20 percent based on state-mandated test scores

AG ScamHelp.com is a web based-app that allows users to search the name of any real organization offering mortgage assistance. The app will show that an organization is "Trusted" if it is part of the Attorney General's Homeowner Protection Program, or has been approved by the U.S. Department of Housing and Urban Development. It will also warn consumers of some of the hallmarks of mortgage rescue scams

The New York State Department of Health today announced the selection of regional contractors for the Population Health Improvement Program, to promote the "Triple Aim" of better care, better population health, and lower health care costs. The contractors will convene meetings of local stakeholders and provide a neutral forum for identifying, sharing, disseminating, and helping to implement best practices and strategies to promote better health outcomes. State Police in Sidney arrested 52-year-old Shayne Edwards of Unadilla for DWI with a BAC result of .17% and Unlawful Possession of Marijuana following an accident on State Route 7 extension to I- 88 in the town of Unadilla. Edwards was issued uniform traffic tickets and an Appearance Ticket to own of Unadilla January 19th

Senator Seward is partnering with the New York State Department of State to inform senior citizens and others about the alarming trend of senior targeted scams. A specialist with the Division of Consumer Protection will conduct the free presentation, helping senior citizens proactively protect their identities and avoid becoming the victims of a scam. The senior scam prevention forum will take place on Tuesday, December 16th from 1:00 p.m. to 3:00 p.m. at the Sidney Memorial Public Library, 8 River Street in Sidney. The forum is free and open to the public.
A new state law bars employers in New York from firing volunteer firefighters, and members of volunteer ambulance squads, for taking time off from their jobs to respond to major emergencies such as hurricanes and snowstorms. The law, approved by the state Legislature this summer and signed by Governor Cuomo, takes affect Dec. 22nd. It requires employers to grant a request from a volunteer firefighter, or a member of a volunteer ambulance corps, for leave to respond to declared states of emergency. The governor can declare states of emergency in cases of man-made or natural disasters

The next to last meeting is scheduled for tomorrow, but no decisions are expected at Tuesday’s meeting. The commission is has been tasked with located 4 casinos in 3 areas of the state, one in the southern tier, the other 2 are the Capital region & the Catskills/Hudson valley region.

The governor has the power to remove any criminal case from a local prosecutor and assign it to the state attorney general’s office, governor Cuomo may be considering a permanent change in the 2015 legislative agenda to be announced in January.

Staff and students at the Sidney Central School district showed their support Ronald McDonald House of Rochester & for 12 year old Francisco LaBoy, a students who was diagnosed with a brain tumor at age 3, and who spent time at their Rochester facility. Lori Stevenson from Ronald McDonald House was at the Sidney school of a special assembly today to collect $1500 that was raised through the “Wear Your Striped Socks” fundraising campaign:

Delaware County Sheriff Deputies responded to a reported 1-car motor vehicle accident on State Highway 10 in the Town of Walton. Deputies arrested 55 year old Richard Wood of Walton, for driving while ability impaired by drugs, he was released with appearance tickets made returnable for Town of Walton Court at a later date.
A decision on where up to 4 casinos will be located in upstate New York is expected to be announced December 17th, when a board reviewing casino applications is expected to meet for the final time. The board is choosing from 16 applications, with 4 licenses are set to be awarded for 3 upstate regions: the Albany-Saratoga area, the Southern Tier-Finger Lakes region and the Catskills and mid-Hudson Valley. The decision will be made following months of public hearings and presentations on the proposals.
Attorney General Eric Schneiderman called upon the FTC to update the Telemarketing Sales Rule to better protect consumers from unscrupulous telemarketers. Schneiderman & 36 other Attorney general’s offices have asked the FTC to protect consumers from telemarketing fraud and abuse, an average of only 37.5% of funds raised by telemarketers were retained by the charities & in 50.3% of the campaigns, the charities retained less than 30% of the money raised. Schneiderman has taken action against 8 entities under investigation for fraudulent fundraising
Siena Research Institute released its annual New York Poll of Holiday Spending Plans for the year. While spending trends remained the same this year, excitement for the holiday season has dropped. 58% of New Yorkers said they're excited about the upcoming holiday season, down from 72% a year ago. Nearly 2/3rds of New Yorkers are planning on spending the same amount of money this year, only 7% plan to spend more.
Former Greene Police Chief Stephen Dutcher was sentenced to a one-year conditional discharge and ordered to pay $1,255 in fines and surcharges. Dutcher also agreed to pay $3,038 in restitution to the Village of Greene and signed a 5-year order of protection in favor of his estranged wife. He pleaded guilty in September to 2 counts of official misconduct and 1 count of 2nd degree criminal contempt. Dutcher was arrested April 24 after state police responded to a request from Greene officials regarding missing village property.
The New York State Department of Taxation and Finance announced today that e-filing continues to gain strength, reducing by 15% the number of paper income tax returns filed during last year’s tax season. Nearly 90% of the 10.4 million income tax returns received were e-filed—an increase of 4% from the previous year, the savings for New Yorkers adds up to $45 million each year. The increase in e-filing also contributes to the Department’s ability to issue refunds 27% faster than in previous years, with the average refund now issued in 22 days.

Delaware County Sheriff Deputies responded to a reported 1-car motor vehicle accident on State Highway 10 in the Town of Walton. Deputies arrested 55 year old Richard Wood of Walton, for driving while ability impaired by drugs, he was released with appearance tickets made returnable for Town of Walton Court at a later date.
A decision on where up to 4 casinos will be located in upstate New York is expected to be announced December 17th, when a board reviewing casino applications is expected to meet for the final time. The board is choosing from 16 applications, with 4 licenses are set to be awarded for 3 upstate regions: the Albany-Saratoga area, the Southern Tier-Finger Lakes region and the Catskills and mid-Hudson Valley. The decision will be made following months of public hearings and presentations on the proposals.
Attorney General Eric Schneiderman called upon the FTC to update the Telemarketing Sales Rule to better protect consumers from unscrupulous telemarketers. Schneiderman & 36 other Attorney general’s offices have asked the FTC to protect consumers from telemarketing fraud and abuse, an average of only 37.5% of funds raised by telemarketers were retained by the charities & in 50.3% of the campaigns, the charities retained less than 30% of the money raised. Schneiderman has taken action against 8 entities under investigation for fraudulent fundraising
Siena Research Institute released its annual New York Poll of Holiday Spending Plans for the year. While spending trends remained the same this year, excitement for the holiday season has dropped. 58% of New Yorkers said they're excited about the upcoming holiday season, down from 72% a year ago. Nearly 2/3rds of New Yorkers are planning on spending the same amount of money this year, only 7% plan to spend more.
Former Greene Police Chief Stephen Dutcher was sentenced to a one-year conditional discharge and ordered to pay $1,255 in fines and surcharges. Dutcher also agreed to pay $3,038 in restitution to the Village of Greene and signed a 5-year order of protection in favor of his estranged wife. He pleaded guilty in September to 2 counts of official misconduct and 1 count of 2nd degree criminal contempt. Dutcher was arrested April 24 after state police responded to a request from Greene officials regarding missing village property.
The New York State Department of Taxation and Finance announced today that e-filing continues to gain strength, reducing by 15% the number of paper income tax returns filed during last year’s tax season. Nearly 90% of the 10.4 million income tax returns received were e-filed—an increase of 4% from the previous year, the savings for New Yorkers adds up to $45 million each year. The increase in e-filing also contributes to the Department’s ability to issue refunds 27% faster than in previous years, with the average refund now issued in 22 days.

Sidney village police arrested 31-year-old Carlene Morgan of Wells Bridge, following a 2-vehicle accident on Delaware Avenue Tuesday afternoon. Morgan was charged with DWI, aggravated DWI with a blood alcohol content of .18 or higher, aggravated unlicensed operation of a motor vehicle, & failure to keep right, she is accused of losing control of her vehicle and crashing head on into a vehicle in the opposing lane. Morgan was arraigned and faces action in Sidney village court at a later date. The operator of the other vehicle was taken to Tri Town Regional hospital for treatment of injuries; police have not released the name of the 2nd driver.

The scam involves a call to a senior citizen in which the caller impersonates a grandchild claiming to be in serious trouble and asks the unsuspecting grandparent to wire money immediately. The FTC recorded more than 40,000 incidents of grandparent scams since 2010. Schneiderman warns the grandparent scam tends to increase in frequency during school breaks. Read more at ftc.gov.

The Teacher Expense Deduction will enable over 100,000 teachers in New York, to deduct up to $250 per year from their tax bill. The deduction will help offset the $485 on average that teachers spend each year to provide additional supplies for their students. The tax benefit went into effect in 2002, but expired in 2013. Congress is considering provisions to reinstate and extend various tax benefits and the Teacher Expense Deduction is included in that package.

Attorney General Eric Schneiderman today announced that his office has obtained a judgment against home improvement contractors who ripped off customers in the Southern Tier and Central New York by going door-to-door seeking to pave and repair driveways. The contractors performed shoddy and incomplete work, intimidated customers into paying more than the negotiated price, and failed to abide by New York’s home improvement contract laws. Schneiderman entered into an agreement to settle his investigation against Joshua Cooper of Ovid and Robert Cooper of Romulus, who were doing business as Finger Lakes Asphalt. the Coopers will be required to pay $8,150 in restitution to 6 consumers

In 2010, the New York State Department of Transportation closed six rest areas on interstate highways in what was touted as a temporary measure. To date, only the Worcester rest stop is scheduled to reopen. Seward also advocated for budget funds to reopen the I-88 Wells Bridge rest stop; it has not been funded in the state budget. The Worcester rest area will be open for parking only at this time. Renovation work on the restrooms is still being completed with a 2015 opening planned.

High school guidance counselors and volunteer college admission staff across the state will help thousands of high school seniors at nearly 200 high schools apply for admission to college, more information is available at GoCollegeNY.org.

The Audit found that revenue and expenditure projections in the preliminary budget are reasonable, but the Town’s projections for rental income in the Hospital Fund were not based on amounts expected to be received according to current lease agreements. The Town did not budget for an additional $95,000 in nonrecurring rental income, but did include $30,000 of lease payments for which no lease agreement exists. The Town underestimated rental revenue by a total of $65,000 & they are currently reporting accounts payable in the Hospital Fund related to the hospital, which closed in 2005. The Comptroller's report recommends that if these payables are legitimate liabilities & if not remove them from the balance sheet.
The Bainbridge-Guilford Central School will hold a Special Board of Education Meeting tonight in the District Conference Room at 5:30 PM. The board will move into executive session for personnel interview sessions.

Insurance company AIG has agreed to pay New York state $35 million to settle claims that two former subsidiaries did business without licenses and misled regulators about their operations in the state. The deal was announced by the state Department of Financial Services. It comes after a $60 million settlement in March with MetLife, which purchased the subsidiaries from AIG. Authorities had alleged subsidiaries American Life Insurance Co. and Delaware American Life Insurance Co. sought customers in New York without licenses and without telling regulators. Under the settlement, AIG will drop a legal challenge to the state's probe and the state will not proceed with charges or a lawsuit

A panel created by Governor Cuomo laid out a plan to guide the spending of a $2 billion bond for increasing technology in schools, but voters will have to approve the borrowing next Tuesday. If approved, school districts would submit specific plans on how they would spend their share of the bond, on equipment like whiteboards, laptops and tablets; installing high-speed or wireless Internet; or installing "high-tech security features" in schools.

State Police will conduct a special traffic enforcement effort during the Halloween weekend. The effort will begin on Thursday and continue through Sunday, Drivers can expect sobriety checkpoints, additional patrols, underage drinking and sales to minor's enforcement. Last year, there were more than 1,300 accidents, 6 people were killed, 324 were charged with DWI and more than 21,000 tickets for speeding, distracted driving & other traffic violations were issued.
State tax collections of $34.2 billion through the first half of the fiscal year were nearly $610 million higher than projected and the state collected nearly $3.5 billion from financial settlements through September, according to the state Comptroller Tom DiNapoli. If approved, school districts would submit specific plans on how they would spend their share of the bond, on equipment like whiteboards, laptops and tablets; installing high-speed or wireless Internet; or installing "high-tech security features" in schools.

The con involves grandparents receiving a phone call from someone purporting to be their grandchild, who is in trouble with the law and in need of money in a hurry, the unsuspecting grandparents wire money to a specific address under false pretenses. State Police will conduct a special traffic enforcement effort during the Halloween weekend. The effort will begin on Thursday and continue through Sunday, Drivers can expect sobriety checkpoints, additional patrols, underage drinking and sales to minor's enforcement. Last year, there were more than 1,300 accidents, 6 people were killed, 324 were charged with DWI and more than 21,000 tickets for speeding, distracted driving & other traffic violations were issued.
State tax collections of $34.2 billion through the first half of the fiscal year were nearly $610 million higher than projected and the state collected nearly $3.5 billion from financial settlements through September, according to the state Comptroller Tom DiNapoli.
