New Yorkers oppose giving the state Legislature its first raise since 1999, and they remained split over whether the state should have moved forward with hydraulic fracturing, according to a Siena College poll. Voters oppose a legislative pay raise, 63 to 28%. Despite voters being evenly split upstate, the state's tough gun-control law called the SAFE Act was supported, 58 to 33% statewide. Voters were also evenly divided on the Dream Act that would provide tuition assistance to illegal immigrants, with 44% supporting it and 48% opposing it. Governor Cuomo had a 58% to 37% favorability rating, up slightly from October.
Action has been taken against several retailers after an investigation revealed many were selling toy guns that appear to be real. Attorney General Eric Schneiderman's office sent cease and desist letters to stop the online sales and shipments of toy guns that do not have required distinguishing designs. State law prohibits the sale of imitation guns in realistic colors, unless it has a one-inch wide orange stripe running down both sides of the barrel. Some toy guns could be mistaken for real weapons by both law enforcement and the general public. Since 1997, at least four people have died when law enforcement mistook toy guns for the real thing.

Starting today, public service announcements will begin airing in movie theaters across New York State & 10 new “Real Story” videos have been posted to the state’s Combat Heroin website, at combatheroin.ny.gov. The PSAs and new videos show New Yorkers sharing their stories of recovery and addiction, the PSAs will be shown in movie theaters through early January, The Combat Heroin website now has 22 videos of New Yorkers describing heroin or prescription opioid addictions. combatheroin.ny.gov/real-stories.
The state DEC is reminding New Yorkers that as of January 1st, old electronic equipment must be recycled, not thrown in the trash. That includes computers, cell phones, televisions, stereos and other devices that plug in or run on batteries. On DEC's electronics recycling web page, consumers will find the brand of equipment they wish to recycle, as well as a link to the manufacturer's recycling program web page and a toll-free number for information about recycling. About three quarters of public high school students in New York graduated on time in June, though graduation rates in the state's largest cities remain far lower, according to data released by the state Education Department. A total of 76.4% of students who entered 9th grade in 2010 graduated with a diploma before June 2014, up slightly from the 74.9% who graduated within 4 years the previous year.

The bill, introduced by Assemblywoman Donna Lupardo, creates an agriculture pilot program to study ways to cultivate and manufacture products with the multi-use crop. It passed both houses of the State Legislature in the spring. Colleges and universities, including Cornell, Binghamton University, may take part in New York's research program.

Governor Cuomo received a status report outlining progress by State agencies to protect New Yorkers from the potential risks with the transport of crude oil. 66 actions have been implemented to strengthen standards, regulations and procedures to make the transport of crude oil by rail and water in New York safer, and to improve spill preparedness and response. The rule changes followed explosions of crude oil on trains in North Dakota that were scheduled to be shipped across the State.
State Police arrested 21-year-old Alexander Church of Delhi for Driving While Ability Impaired by Drugs and Unlawful Possession of Marihuana. The arrest resulted from a traffic stop for failing to keep right while driving on State Route 28 in Franklin, Church is accused of driving while impaired & also unlawfully possessed approximately three grams of marihuana, he was issued tickets returnable to the Town of Franklin Court on December 11th.
New York State has identified 278 licensed gun owners who could lose their weapons because they are considered mentally unstable. At least eight of them are Central New Yorkers, half of whom have had their guns and permits taken away by authorities. Psychiatrists and other health professionals reported these individuals to the state because they appeared to be at risk of harming themselves or others. Under a provision of the SAFE Act, mental health providers have reported over 38,000 at-risk patients, 737 of them from Central New York
State Comptroller Tom DiNapoli announced the release of several municipal audits, including for the Village of Bainbridge. The audit found that the board did not request adequate reports from the clerk-treasurer and was unable to make informed financial decisions. In addition, the clerk-treasurer’s records understated the total fund balance of the general, water and sewer funds by a combined $233,000. The report & the village’s response to the audit are available at osc.state.ny.us.
Governor Cuomo today announced that the State University of New York has adopted a uniform sexual assault prevention and response policy for SUNY campuses. The policy is being disseminated today to each campus’ official’s implementation. The policy follows the resolution passed by the SUNY Board of Trustees in October, The Governor also today launched a new website that provides information regarding sexual assault prevention and response for students, parents, administrators and law enforcement at campuscrime.ny.gov.

Delaware County Sheriff’s Deputies & the Chenango County Sheriff’s Office arrested 29 year old Jonathan Hopkins of South Plymouth on an arrest warrant issued by the Delhi Town Court. Hopkins is a Level 3 Sex Offender, he was charged with 1 count of Failing to Report a Change of Address within 10 days and 1count of Failing to Verify an Address every 90 days. Hopkins was arraigned & was remanded to the Delaware County Correctional Facility on $5,000 cash bail or $10,000 bond.

State Police from Oneonta arrested 18 year old Brian Colon of the Bronx and 18 year old Nicole Nunez of Manhattan for Criminal Possession of a Forged Instrument. The arrests occurred after an off duty Trooper called and reported that he had possibly received counterfeit ten dollar bills from a man during a sale on Craigslist. The investigation determined that the off duty Trooper was selling four tire rims on Craigslist and agreed to meet Colon in Oneonta to complete the transaction, Police accuse Colon of paying the Trooper with 70 counterfeit ten dollar bills, and that Nunez had also knowingly possessed several counterfeit ten dollar bills. Colon and Nunez were both arraigned in the Town of Oneonta Court and remanded to the Otsego County Jail in lieu of a $750 cash bail.
Governor Cuomo announced that the White House Office of National Drug Control Policy has commended the State's program that trains law enforcement officers to administer naloxone, to reverse heroin and opioid overdoses. 1,400 police officers from 54 counties have attended the State's training, and emergency responders have used the naloxone to save the lives of 38 New Yorkers who had overdosed. Governor Cuomo also announced a new public awareness and education campaign featuring a website, combatheroin.ny.gov.

Tickets are $5 each; the prize pool starts at $15 million and grows up to $25 million if there is no winner. The game is projected to bring in more than $34 million annually for the state
Candidates for the state’s 121st Assembly District will debate the tonight at the League of Women Voters of candidate forum at 7 p.m. at Morris Hall at the State University of New York at Oneonta. Incumbent assemblyman Bill Magee will debate his Republican opponent John Salka, who is currently serving his fourth term as Brookfield Town Supervisor. Magee is completing his 12th term in office. A newly created database of New Yorkers deemed too mentally unstable to carry firearms has grown to 34,500 names. The database is the result of the Safe Act. Gun control supporters argue a wide net is appropriate, given the potentially dire consequences. Under the law, the reports prepared by doctors, psychologists, nurses and social workers are first sent to county officials. If they agree with the assessments, the officials then input the names into the state database. The information is retained for five years. If the authorities find a person in the database has a gun permit they are required to revoke the license and seize any guns. The people in the database are barred from obtaining a permit until their names are purged
The U.S. Environmental Protection Agency, has awarded $197 million to New York State, to help finance improvements to water projects to protect public health and the environment. The money will be used to upgrade sewage plants and drinking water systems throughout the state. This funding, which is awarded annually, is in addition to the $340 million NY recently received for Hurricane Sandy resiliency projects
The State Police Bureau of investigation and State Police Computer Crimes Unit arrested 20 year old William Miller of Pittsfield for promoting a sexual performance by a child and possessing a sexual performance by a child. Miller was arraigned in town of Morris court and sent to the Otsego County jail on $5,000 bail. He will re-appear in town of Pittsfield court November 3rd

The pick of Leslie Stein, means Democrats will have four of the seven seats on the Court of Appeals, for the first tim in modern history. It's the third Democratic woman picked for the court since Cuomo took office in 2011. If re-elected Nov 4th, Cuomo would be able to appoint the four other seats, allowing him to reshape the entire court. Court of appeas judges serve for 14 years, but must retire at age 70. The appointments require state Senate confirmation

The state Health Department announced that 14 cases of the Enterovirus were confirmed in western New York. The virus has landed a significant number of children at health centers and hospitals across the country. Enterovirus results in difficulties breathing and severe respiratory issues. There is no vaccine to prevent the infection and there is no anti-viral medication to treat the infection. Prevention methods include washing hands, avoid touching eyes, nose and mouth and disinfecting frequently touched surfaces.
State Troopers arrested 52-year-old Robert Slack of Susquehanna, Pennsylvania for Driving While Intoxicated, following a motor vehicle accident on State Route 205 in Oneonta. Slack refused to submit to a blood test. He was issued a ticket returnable to the Town of Oneonta Court on October 7th.

Smith was charged with Criminal Possession of a Weapon, which violated the terms of his probation in Ulster County. Smith is accused of possessing a switchblade knife, & he may also face drug possession charges upon completion of a laboratory analysis of the seized drugs. Smith was arraigned in the Town of Middletown Court and remanded to the Delaware County Jail on $1000 cash bail.
Assemblyman Bill Magee nearly doubled his campaign coffers in the final days of his successful fight to hang onto his seat, according to the state Board of Elections. Magee raised $54,305 between August 25th and September 15th in his effort to defeat Sherrill City Commissioner Mike Hennessy in the democratic primary. Magee beat Hennessy 2,082 to 1,431; he will face Republican John Salka of Brookfield in the November election.
Home sales in New York fell 9.5% in August compared to the same period in 2013. Median sale prices stayed flat, while some areas of the state, including the Southern Tier, had an increase in homes on the market and fewer sales. Nearly 11,000 homes were sold in New York in August, the year-to-date sales total of 66,635 was a 4.4% drop compared to the same period in 2013. The median sale price so far this year was $225,000, unchanged from a year ago. Pending sales fell 1.5%.

The Act is state's 1st anti-bullying legislation, the results of the survey will be used to identify steps that schools have taken, and model policies and practices now being implemented by districts, to help ensure students are provided safe school environments.
The New York National Guard and the State Department of Homeland Security and Emergency Services are giving a free two-hour training session At 11 AM Saturday on the SUNY Broome campus. Those who register will receive a backpack filled with supplies that can assist in the event of an emergency. Registration for the event is free but space is limited. Students in the Milford Central School District were sent home early this afternoon. District Officials said that a water main Break necessitated the early dismissal; they hope to be back open regular hours tomorrow.

Binghamton fire fighters responded to a 2-alarm blaze at the Ellis Brothers Furniture Store on Water Street. Area businesses have been evacuated, and Binghamton High School classes were cancelled at 10:30 this morning due to poor air quality downtown. Binghamton Police closed down Court Street from Front Street to State Street. Water Street is closed from Court to Henry streets.
38-year-old Ganesh Ramsaran will stand trial for murder in Chenango County court in September. Jury selection will start September 2, Ramsaran was arrested for 2nd degree murder for the death of his wife Jennifer, who was reported missing in December of 2012, her body was found several months later in a wooded areas in the town of Pharsalia.
State Comptroller Tom DiNapoli proposed legislation to help ensure that contractors doing business with state agencies are held to high ethical standards while performing important governmental services. The Comptroller’s proposal would establish clear nondisclosure standards for contractors in order to protect the public interest, and subject many state contractors to ethics provisions similar to those of state employees. With this increase, New York State has allocated more than $1 billion for grants and scholarships for New York students who pursue higher education at a public or private college in the State. Last year, TAP served nearly 400,000 students across the State.
New York’s education policymakers agreed to temporarily ease certification requirements for new teachers, after a number of colleges and labor unions raised concerns about a new exam. The state Board of Regents voted to allow teaching hopefuls, who fail New York’s new teacher performance assessment, to receive their initial 5-year certification, but only if they pass a separate written exam. The eased requirements would only be in effect for those who take the exam before the end of June 2015. The board also approved the creation of a taskforce to review the handbook, review materials for the exam and recommend ways to improve it.
New York has raised the state’s maximum college tuition grant for the coming academic year to $5,165. The $165 increase is the first in 14 years. Nearly 400,000 state residents received Tuition Assistance Program awards last year. They can be used for higher education at public or independent colleges or universities in New York. In the 2012-2013 academic year, more than 372,000 New Yorkers got $931 million in tuition assistance program funds, averaging $3,049 per student.

Another proposal would require all semi-automatic handguns, sold in the state, to be equipped with a device that stamps a unique code into a shell casing each time the gun is fired, making it easier for authorities to track guns used in shootings. Lawmakers passed the SAFE act, which bans the sale of many semi-automatic weapons and requires registration.

The Chenango County Sheriff's Department arrested 42 year old Christopher Turner of Preston on 2 counts of 1st degree Assault, 1st Degree Burglary, Aggravated Criminal Contempt, Criminal Possession of a Weapon, Criminal Mischief & Endangering the Welfare of a Child. Turner is accused of unlawfully entering a residence and assaulting 2 residents, 1 of the victims had an active order of protection against Turner. Turner was found to have used a dangerous instrument during the assault. The unidentified victims were transported to local hospitals to be treated for their injuries; deputies said that there were 4 children in the residence during the incident, which also had active order of protections against Turner. Turner was arraigned in the Town of Preston Court and was remanded to the Chenango County Correctional Facility on $ 00,000 cash bail and is to reappear in court at a later date.
Chenango county sheriff’s department arrested 47 year old Jeffery Eaves of Earlville on charges of 2nd degree Assault, Aggravated Harassment against a Police Officer, Resisting Arrest, DWAI and several moving violations. Eaves was stopped by a deputy who witnessed a moving violation in Earlville, Eaves continued driving a short distance to his home, where exited his truck, and attempted to flee on foot. Eaves is also accused of assaulting the deputy, he was taken into custody, was arraigned in Earlville Court and was remanded to the corrections in lieu of $10,000 cash bail. Eaves will reappear at a later date.
New York Gun Owners have until tomorrow to register their ‘assault rifles’ as part of the New York SAFE Act. those with a regulated firearm must register it with the state to keep it legal. The State has a link from the governor’s homepage, to an interactive questionnaire to tell if a gun should be registered. State Police remind gun owners that failure to register an assault weapon by the deadline is punishable by forfeiture of the weapon, If it is “deemed to be unintentional,” a 30-day amnesty period will be extended to register it.
U.S. Senator Charles Schumer and Congressman Richard Hanna announced that 7 Southern Tier stream gauges would receive long-term funding. The gauges faced a shut-off deadline of October 1st, due to a lack of federal funding. The U.S. Geological Survey identified new long-term support for the gauges. Much is due to the fiscal year 2014 Omnibus appropriations bill, along with additional support from the state DEC. The Southern Tier gauges are on the Susquehanna River at Bainbridge, Windsor, Unadilla, Binghamton and Owego.

In addition to identifying poles in need of repair or replacement, NYSEG’s contractor will be treating some poles to increase their longevity. The preservatives used are approved by the U.S. Environmental Protection Agency, New York State Department of Environmental Conservation, and will be applied under the supervision of licensed applicators. Any poles infested with carpenter ants also may be treated with an approved insecticide.

The Chenango County Sheriff’s Department arrested 43 Year old Gary Cameron of Norwich on charges of –Criminal Contempt, Aggravated Harassment, & criminal Mischief. Cameron was charged following a domestic dispute in Norwich, destroying the victim’s property, with a 6-year-old child present. Cameron was arraigned & was released on his own recognizance and scheduled to reappear in court at a later date. He was arrested again for violating an order of protection issued by the court & was then remanded to the Chenango County Jail on $500 cash bail pending court action.
The State Labor Department released unemployment rates for February 2014. The state’s private sector job count rose by 117,200 since February 2013, & the unemployment rate was unchanged at 6.8%. The economy added 12,800 private sector jobs in February, bringing the state’s private sector job count to a record high of 7,543,100. Locally, Chenango County's unemployment rate is 7.7%, Delaware County 8.3% and Otsego County 7.6%
New York State of Health reported that 1,2 million new Yorkers completed their applications and 865,487 have enrolled for coverage since the launch of the Marketplace on October 1st. on Monday, the deadline day, almost 39,000 New Yorkers enrolled in coverage & nearly 134,000 enrolled over the last week.
A few thousand protesters rallied against New York’s gun-control laws yesterday, at an Albany rally featuring an appearance from Donald Trump. The protesters filled the south end of Albany’s Empire State Plaza, as speakers berated Governor Cuomo and the state Legislature, for passing the New York Safe Act last year. Trump was joined at the rally by Republican gubernatorial hopeful Rob Astorino and 2010 GOP nominee Carl Paladino, who is considering a run on a 3rd party line. State police reported that the protest was peaceful and no arrests were made.
Trout season opened Tuesday in New York State, however, Anglers said that rivers were too fast for them to catch anything. Fishing licenses are required for anyone over the age of 16; more information is available at dec.ny.gov. The season runs through October 15th.

The Chenango county sheriffs department arrested 55 year old Max Welch of Afton on charges of DWI, driving with a BAC greater than.08%, unlicensed operation of a motor vehicle, felony aggravated unlicensed operation of a motor vehicle, and a turn signal violation. Welch was charged following a traffic stop in the Village of Afton, he was found to be intoxicated, having an expired & revoked driver’s license, he was arraigned & was remanded to the Chenango County Correctional Facility on bail and will reappear in the Village of Afton Court at a later date.

A 20-year-old bill to make it easier for adoptees over the age of 18 to get their original birth records is up again in the state Legislature. Supporters of the Bill of Adoptee Rights argue that information from unsealed birth records is vital to the medical and mental health of adoptees, while opponents claim easing disclosure rules could violate a biological parent’s privacy.
Now that the Federal farm Bill has been passed, the agricultural community can proceed to thrive in New York State with a definite plan in place, and federal money coming to fund programs. Chenango County Farm Bureau director Bradd Vickers said that the bill covers a lot more than most people think:

President Obama signed the farm bill last week; it took congress more than 2 years to reach an agreement on the 5-year plan.
Governor Cuomo’s state budget proposal includes an additional $3.2 million for personnel costs related to the SAFE Act. State police Superintendent Joseph D’Amico said the money will go toward hiring civilian employees to help with administrative duties related to the gun laws, including the processing of assault-weapon registrations and maintaining records. The budget also includes about $27.7 million for information technology costs, including the creation of a statewide database for background checks on ammunition purchases.
The state Republican convention this year will be held in Westchester County. The convention will be held on May 14th & 15th at the Hilton Westchester in Rye Brook, No Republican has formally declared for the 2014 governor’s race, though the Westchester County executive Rob Astorino opened an exploratory fundraising committee last week. The location of the Democrats’ 2014 convention has not yet been announced.

Supporters of the Bill of Adoptee Rights argue that information from unsealed birth records is vital to the medical and mental health of adoptees, while opponents claim easing disclosure rules could violate a biological parent’s privacy.
Now that the Federal farm Bill has been passed, the agricultural community can proceed to thrive in New York State with a definite plan in place, and federal money coming to fund programs. Chenango County Farm Bureau director Bradd Vickers said that the bill covers a lot more than most people think:

President Obama signed the farm bill last week; it took congress more than 2 years to reach an agreement on the 5-year plan.
Governor Cuomo’s state budget proposal includes an additional $3.2 million for personnel costs related to the SAFE Act. State police Superintendent Joseph D’Amico said the money will go toward hiring civilian employees to help with administrative duties related to the gun laws, including the processing of assault-weapon registrations and maintaining records. The budget also includes about $27.7 million for information technology costs, including the creation of a statewide database for background checks on ammunition purchases.
The state Republican convention this year will be held in Westchester County. The convention will be held on May 14th & 15th at the Hilton Westchester in Rye Brook, No Republican has formally declared for the 2014 governor’s race, though the Westchester County executive Rob Astorino opened an exploratory fundraising committee last week. The location of the Democrats’ 2014 convention has not yet been announced.
The Chenango County Sheriffs department arrested 47-year-old Leon Beckwith of New Berlin for 2nd degree Harassment & resisting arrest. Beckwith was charged after acting aggressively with an investigating deputy, he was arraigned was remanded to the Chenango County Correctional Facility on cash bail, he will reappear in the Town of New Berlin Court at a later date.
