38-year-old Dwight Burton of Johnson City will appear in Johnson City Court Friday afternoon, he faces charges of murder & arson in connection with the house fire at 145 Floral Avenue in Johnson City early Monday morning. 2 women were injured & were sent to the Upstate University hospital burn unit in Syracuse, 2 small boys died in the fire.
State Police arrested 34 year old Zenaida Montanez of Endwell, for driving while impaired by drugs, criminal possession of a weapon & criminal possession of a controlled substance they also arrested 60 year old Gulberto Montanez of Endwell for 2 counts of criminal possession of a weapon & 1 count of criminal possession of a controlled substance. Trooper’s responded Wednesday afternoon to a report of a vehicle driven by a woman while a man was seen holding a handgun on State Route 17 in Vestal, Troopers found the vehicle in the Town of Dickinson; police found weapons and crack cocaine. Zenaida Montanez was issued a ticket returnable to the Town of Dickinson on November 3rd while Gulberto was arraigned & was remanded to the Broome County jail with no bail set.
The State Assembly Task Force on the Heroin crisis held their 6th forum in Binghamton this week, local assemblyman Cliff crouch serves on that task force. Crouch told WCDO News that law enforcement officials testified that more has to be done from outside law enforcement:

Crouch also said that part of the problem is that insurance and Medicaid covers 3 days of coverage after an overdose, which usually needs 7 days to get passed the high pain levels of withdrawal from heroin.
State Police arrested 26-year-old Joshua Gould of Exeter for 3rd degree Assault, criminal obstruction of breathing and unlawful imprisonment. The arrest occurred after a report of a domestic dispute Tuesday in the Town of Exeter. Troopers determined that Gould allegedly physically restrained his Girlfriend, chocked her and caused an injury to her head. Gould was arraigned and was remanded to the Otsego County jail in lieu of $500 cash bail or $1,000 bond & an order of protection was issued.
The Delaware county Chamber of Commerce has a new executive director. Former Director Ray Pucci of the town of Meredith returned October 1st, replacing Mary Beth Silano who relocated to Connecticut. Pucci served as Delaware county Chamber executive director through 2001 when he took a position at Coldwell banker Timberland Properties in Margaretville.

Governor Cuomo signed multiple pieces of legislation designed to protect and further women’s equality in New York State. The new laws will help achieve pay equity, strengthen human trafficking laws and protections for domestic violence victims and end pregnancy discrimination in all workplaces. The Governor also announced that New York State has allocated a total of $6.4 million for Sexual Assault Prevention and Assistance providers across the State.

At about 12:45 this afternoon, the DCMO BOCES Harrold Campus in Masonville, was evacuated, after a note was found indicating a threat to the building. The School Resource Officer and the building principal contacted local law enforcement officials, who responded immediately. Students and staff were moved to the lower yard, where they remained until either their district transportation arrived. The building was declared safe for re-entry at 2:03 p.m.   The investigation is continuing.


Governor Cuomo today announced nearly $710,000 in state grants to 51 police departments and sheriffs’ offices across the state for the purchase of electronic fingerprinting equipment. This new equipment will replace existing devices that either malfunction or are obsolete. Locally, the Otsego County Sheriff’s Office received $10,000 & the Chenango County Sheriff’s Office: $18,131 for two devices
Basil Seggos will be the new commissioner of the state Department of Environmental Protection. Seggos was Governor Cuomo’s deputy secretary for the environment; he replaces Joseph Martens, who resigned from the post in July.
On Sunday afternoon, Delaware County Sheriff’s Deputies arrested 63-year-old Patricia Carlson of Delhi for felony DWI, & felony aggravated unlicensed operation, following an investigation of a 1-car motor vehicle accident on Archie Elliot Road in the Town of Meredith. Carlson was additionally charged with unlicensed operator, operating a motor vehicle with an open container of an alcoholic beverage & failure to keep right, she was arraigned in Delhi Town Court and was remanded to the Delaware County Jail on $1000 bail.
The Official launch & open house of the Otsego Now Regional Workforce Training Center initiative and announcement of significant grants, will be tomorrow morning in Oneonta. State Senator Jim Seward helped to secure the grants and guide the through the CFA process, for capital improvements to outfit the center. Seward is scheduled to attend the ceremonies beginning at 10:30 AM Tuesday at the Offices of Otsego Now at 189 Main Street on the 5th floor.
Camp Hope Veterans Outreach announced a Launch party Fundraiser on Sunday October 18th, at the Unadilla Community Field, from 12:00 Noon to 4:00 PM. The organization seeks to build a facility in Sidney, where dogs will be trained to assist veterans suffering from Posttraumatic Stress Disorder. Fire fighters from 3 area departments responded to the report of a Structure fire at 1133 Webb Hill Road in the town of Davenport. The fire was reported at about 10:50 this morning, WCDO News will have more details as they become available.
Oneonta Police arrested 47-year-old John Nack of Oneonta on felony drug charges. Nack was charged with criminal sale of a controlled substance and criminal possession of a controlled substance, for illegally possessing & selling heroin in August. Nack was arrested at the Otsego County jail where he was being held on other charges, he was arraigned in County Court and sent back to the County jail, pending later court appearances.
Early Saturday morning, Binghamton Police responded to a 911 call of gunshots near f Gerard Avenue & Murray Street. officers found a 20 year old male lying in the roadway with a gunshot wound to the chest, he was taken to an area hospital and was listed in critical condition over the weekend. Binghamton Police charged 26 year old Walter Andino Jr. of Binghamton for attempted Murder, he was arraigned in City Court and remanded to the Broome County Jail, the . investigation is continuing and the Binghamton Police encourage anyone with information to call the Detective Bureau at 772-7080.
Attorney General Eric Schneiderman today announced the arrests of 68-year-old Kenneth Cohn and his wife, 64-year-old Sharon Cohn of Binghamton, for allegedly violating the Workers’ Compensation law and illegally obtaining over $1 million from the Medicaid system. while owning & operating Yellow Medi-Van and Taxi, Incorporated. The Cohns were charged with Grand Larceny, Offering a False Instrument for Filing among other charges, they were arraigned in Binghamton City Court.

Chenango County Sheriff’s Deputies arrested 24-year-old Anthony Leggiere of Oxford for driving while intoxicated following an investigation into a rollover motor vehicle accident on September 27th on County Road 10 in the Town of Preston. Leggiere was brought to the Chenango County Sheriff’s Office for processing and released on appearance tickets to a sober third party. Leggiere has a later date in the Town of Preston Court.
The Sidney Police Department is investigating a motor vehicle accident in the early morning hours of October 4th on Grand Street Extension. A garbage dumpster was flipped up on its side and a utility pole next to the dumpster was almost severed in half. An eyewitness reported that a white female operating a black SUV had struck the dumpster and utility pole after leaving the village parking lot. The Sidney Police Department is asking for the public's help in identifying the person and vehicle involved in this accident. The vehicle should have extensive damage to its front end. Fire Prevention Week is underway, and the Firemen’s Association of the State of New York is reminding all New Yorkers of the importance of having working smoke alarms throughout their homes. The National Fire Protection Association urges everyone to install smoke alarms in every bedroom, outside each separate sleeping area and on every level of the home, including the basement, to connect all smoke alarms throughout the home so that all sound when one initially goes off. Everyone is also encouraged to test alarms monthly, replace all smoke alarms when they are 10 years old & make sure everyone in the home knows the sound of the smoke alarm and understands what to do when they hear it.
The Delaware County Department of Economic Development will hold three public meetings to discuss the proposed “Bed Tax” for Delaware County in the lodging and accommodating businesses. The public meetings will be held in Delhi today, in Margaretville on October 7th and Hancock on October 12th. All meeting will be at the town halls and will begin at 6:00 PM. Approximately 460,000 New York Medicaid recipients diagnosed with diabetes received diabetes-related services costing more than $1.2 billion in state fiscal year 2013-14, according to a report released by State Comptroller Tom DiNapoli. The report notes that about 1.6 million adult New Yorkers, or 10.3% of the adult population, have been diagnosed with either Type 1 or Type 2 diabetes, which is higher than the 3-year nationwide average of 9.6%.
Runners from all over will participate in this year's "Pit Run" Sunday. The annual race will begin at 10:45 at Neahwa Park in Oneonta, it is named in honor of Late State Police Investigator Rick Parisian of Oneonta, who died trying to stop an armed robbery at an Oneonta supermarket in 1994.
The last day to register to vote in the November 3rd General Election for Delaware county residents is Friday October 9, 2015, it is also the last day for the Board of Elections to receive an enrollment change to be effective for 2016. The 52nd Senate District covering Deposit and Hancock has a 1-year vacancy. County Court Judge and County Family Court Judge and many town offices are up for election. Fire Prevention Safety Week is this Sunday October 4th through Saturday October 10th. The Franklin Fire department will hold their 2nd annual open house & public safety day on Sunday, from 12:00 Noon to 3:00 PM, with free refreshments, free smoke detectors & participation with the American Red cross, Delaware county sheriff's department state police & Bassett health care among others. Governor Cuomo released details last night in Malone, regarding the escape of David Sweat & Richard Matt from the Clinton County Correctional Facility in early June.

Matt was killed by Police Friday, Police caught Sweat last night, he is being treated in an Albany area hospital for 2 gunshot wounds. On June 27, 2015, an autopsy was conducted on the remains of Richard Matt at Albany Medical Center. The autopsy on Matt determined the cause of death to be severe skull fractures and brain injuries due to gunshot wounds to the head, Toxicology results are pending.
The state Department of Environmental Conservation today officially prohibited high-volume hydraulic fracturing in New York State by issuing its formal Findings Statement, completing the state’s 7-year review of this activity. The DEC claims that after their research and examination, Fracking may pose significant adverse impacts to land, air, water, natural resources and potential significant public health impacts that cannot be adequately mitigated.  Hyrdo-fracking was allowed in certain portions of the state from 1979 through 2008, a copy of their "Findings Statement" is available at dec.ny.gov.
State Police confirmed that 31 year old Yishori Hamata, also known as Tyrell Rogers of Morris was found Sunday, in good health, A missing person investigation began June 18, when Hamata's abandoned car was found in New Berlin, More details are expected to be released & the investigation is continuing.
Delaware County Sheriff Deputies arrested 62 year old John Morton of Treadwell on 1 count of Criminal Possession of a Weapon, for allegedly owning a weapon, that he was prohibited from possessing. Morton was arraigned before the Delhi Town Court and released on his own recognizance to reappear on 7/1/15 at Meredith Town Court.
State Comptroller Tom DiNapoli released 2 audits revealing more than $70 million in questionable Medicaid claims and payments. DiNapoli’s auditors found the state reimbursed providers for excessive services, including 41 dental exams for one patient over three years and identified about a dozen providers that should have been kicked out of the system for wrongdoing. DiNapoli recommended the Department of Health review the overpayments identified and make recoveries, strengthen controls over claims processing to prevent improper payments for excessive services; and review the duplicate Medicaid payments identified and recover, as appropriate. DOH officials generally agreed with the recommendations, but indicated that certain findings were outdated because actions have already been taken to address system shortcomings.
Governor Cuomo announced the availability of free summer meals sites throughout the state to provide children from low-income households with fresh, healthy food when schools are out of session. about 360,000 children received free summer meals in New York in 2014, an increase of 9% from 2013. Governor Cuomo announced today that he is taking some personal time to support his Girlfriend Sandra Lee, as she has been diagnosed with breast cancer. Lee is in the early stages of the disease, and faces surgery shortly, Cuomo stated that she had kept her illness private since March & she has decided to speak openly about her illness in order to remind women of the lifesaving power of early detection.
After another pronouncement by the Schoharie County jury of a deadlock in the Cal Harris Murder trial, the jury was once again instructed to keep deliberating. Harris's 3rd trial, and the first in Schoharie County, is the longest one to date, with the jury deliberating over 40 hours over 9 days. Harris is accused of killing his estranged wife Michelle in September 2001.
Delaware County Sheriff’s Deputies arrested a former Walton area parolee On Monday on a County Court Warrant for failure to appear & failure to pay court ordered restitution. Deputies & State Parole Officers arrested 28-year-old Eric Black of Binghamton at the Parole Office in Binghamton following his scheduled appearance with his assigned Parole Officer. Black was convicted of 3rd degree Burglary; he was released from prison in March 2014, subject to Parole supervision. Black was remanded to the Delaware County Correctional Facility without bail pending County Court action today.
New York collected $149.1 billion in revenue in fiscal year 2014-15, an increase of $11.4 billion, or 8.3% from the prior year, largely because of one-time financial settlements and a boost in federal aid, according to a report by State Comptroller Tom DiNapoli. The state collected more than $71 billion in taxes, Business tax collections of $8.5 billion. The state received $48.6 billion in federal grants, which were used primarily for Medicaid, homeland security, public welfare and education.
The Sidney Center Improvement Group is hosting their annual Spring Street Team Cleanup Day this weekend on May 16th. The Group is looking for volunteers to help with cleaning the streets of trash and light debris in and around the Hamlet; they will provide free t-shirts, a full lunch, prizes and all cleanup supplies. A large dumpster will be on site for residents to dispose of trash.
The New York Lottery announced today that an Oneonta woman won the top prize of 1 Million dollars, on a "Cash Deluxe" scratch-off purchased by her boyfriend last month. The woman was not identified in the announcement; a check presentation is scheduled for Wednesday morning at Hannaford's in Oneonta, where the ticket was purchased.

Payne said that there are a number of projects already being discussed from the previous "Reunite Bainbridge" Meeting, including assisting with their wildlife preserve, road signage and the possibility of a "Boys & Girls Club".
The State Department of Labor today released preliminary local area unemployment rates for March. The state's private sector job count increased to 7,753,700, which is an all-time high, the state's unemployment rate fell from to 5.7% in March, and the lowest level since August 2008. Locally, The Greater Binghamton area rate was at 6.3% in March down 7/10's from March of last year.
The office of State Senator Tom Libous announced that the senator has had successful back surgery. During Senator Libous' recovery from recent surgery to repair a detached screw in his spine, it was discovered that additional follow-up surgery was needed. That surgery took place on Monday, & Senator Libous is in contact with Senate Majority Leader Dean Skelos, his Senate staff and voters in his district by phone and email. Libous will return to work in Albany when cleared by his doctor.
State Comptroller Tom DiNapoli announced that audits identified a total of $513 million in improper Medicaid payments and untapped revenue opportunities over a 4-year period. Auditors identified another $361 million in questionable transactions that will require further review and actions to prevent overpayments or recover costs. The state expects to transition the majority of Medicaid spending, services, and enrollees to managed care by 2016, but recent audits by DiNapoli’s office highlight the need for more effective oversight of managed care organizations
The Sidney Police Department arrested 19-year-old Michael Fairbairn of Sidney early Sunday morning for 3rd degree, Petty Larceny and Criminal Mischief; Fairbairn was arrested during a Burglary at the American Legion at 22 Union Street in the village of Sidney. Fairbairn was apprehended hiding near the scene with items taken during the burglary. Fairbairn was arraigned at Sidney Village Court and remanded to the Delaware County Correctional Facility on $10,000 cash bail. Sidney Police was assisted by State Police and Delaware County Sheriff's Office.
Inclement weather forced the postponement of tonight's game between the Binghamton Mets and Erie SeaWolves at NYSEG Stadium. The contest will be made up as part of a doubleheader on Tuesday, August 25th. Ticket holders for tongiht's game can redeem them for a ticket of equal or lesser value to any future 2015 regular season home game, excluding July 4th.

State Police in Norwich arrested 31-year-old Michael Holbert of Sherburne on 1 count of animal cruelty, in violation of the New York State Agriculture and Markets Law. Holbert is accused of failing to provide adequate shelter and sustenance for his dog, which resulted in its death. State Agriculture and Markets Law requires that people must provide adequate food, water and shelter, and that they prevent their animals from being unjustifiably injured.
Governor Cuomo announced the next phase of the statewide “Combat Heroin and Prescription Drug Abuse” awareness campaign to address the opioid epidemic in New York. The campaign includes messages on billboards, posters, online advertisements, social media and commercials that will be aired across the state for four weeks. The “Combat Heroin” website hosts 22 videos of New Yorkers describing first-hand how they or their loved ones progressed from alcohol to marijuana to heroin or prescription opioids and the devastation the addiction caused. Four of these videos will be used in television commercials.
New York State of Health Marketplace today announced that more than 2.1 million people signed up for health insurance by the end of the second open enrollment period earlier this week. 88% of Marketplace enrollees reported that they were uninsured at the time they enrolled.
The state Department of Health failed to collect nearly $120 million in available rebates over a 33-month period from pharmaceutical manufacturers for the Medicaid program because of ineffective policies and processes, according to an audit by State Comptroller Tom DiNapoli. Auditors determined that the Health department can improve its processes by following 12 recommendations from the report, to collect the unclaimed rebates and improve the collection process.
The Chenango Arts Council is bringing back "Scot Bruce" and his band, to perform their "Elvis Presley, All Shook Up" show later this month. Council Director Diane Batson-Smith said that there are some tickets left:

New York’s Medicaid system overpaid pharmacies by more than $1.1 million over a 5-year period for narcotics and other controlled substance prescriptions that exceeded limits allowed by the law, according to an audit of the Department of Health by State Comptroller Tom DiNapoli. Auditors determined DOH’s eMedNY claims processing system did not properly deny claims from pharmacies for controlled substances that exceeded the supply limits put in place by the Controlled Substances Act and thus prevent improper payment. Medicaid overpaid pharmacies $1.2 million for 13,705 improper claims.
Governor Cuomo outlined new reforms in his 2015-16 Executive Budget designed to crack down on delinquent taxpayers and abuses of the STAR program. These steps include the suspension of those who owe more than $4,500 in back taxes from the STAR program, as well as empowering the state Department of Taxation and Finance to recover improperly granted STAR benefits. Currently, if a taxpayer owes more than $4,500 in state tax debt, the STAR benefit is applied to the individual’s tax debt. The Executive Budget will instead stop providing STAR benefits to any taxpayer who owes more than $4,500 in state taxes.
New Yorkers living with Cancer and their families will participate in the 2015 American Cancer Society Cancer Action Network Day at the Capitol today. Society spokesman Mike Burgis comments;

Delaware County Sheriff’s Deputies responded to a domestic incident in the Town of Delhi Sunday, Deputies arrested 45 year old Richard Herrel of Delhi for Criminal Contempt and Trespassing. It is alleged that Herrel violated an order of protection issued by Delaware County Family Court. He was arraigned in the Town of Delhi Court & was released on his own recognizance pending a February 18th court appearance.

Cuomo outlined a transportation and infrastructure plan in New York City this morning, as part of his "Opportunity Agenda 2015"
State Police responded Sunday to a report of a 1-car fatal accident in the town of Otsego. The accident occurred at around 12:40 early Sunday morning on County route 22, where 18-year-old Jacob Matteson of Richfield Springs drifted into the opposing lane, overcorrected & overturned & landed on the roof. Matteson was pronounced dead at the scene.
The Delaware County Sheriff's Office and the State Police Collision Reconstruction Unit are investigating a 1-car accident from Sunday morning on State Highway 30 in the Town of Colchester. 44-year-old Shawn Maynard of Randolph, New York failed to negotiate a curve and struck an earth embankment, causing the vehicle to overturn, 20 year old Candice Brown of Salamanca New York was ejected from the vehicle. Maynard and Brown were taken to Delaware Valley Hospital in Walton; Brown was later transferred to Wilson Hospital in Johnson City, where she was listed in critical condition. Maynard was treated at Delaware Valley Hospital and released. Sheriff’s Deputies are waiting for toxicology results; Maynard may face criminal charges upon completion of that testing and the collision reconstruction investigation.
The State Department of Labor today announced the Region’s Top 5 Trending Jobs for 2015, selected by labor market analysts based on occupational survey data and the projected needs of their region. Job expected to see greater than normal growth are Industrial Machinery Mechanic, Certified Nursing Assistant, Electrician, Welder, & Registered Nurse. The Jobs Express website at jobs.ny.gov, has tens of thousands of jobs available.
State tax collections of just under $8 billion were $474.2 million higher than expected in December according to the December cash report issued by State Comptroller Tom DiNapoli. The state has also collected $4.2 billion from financial settlements since April, approximately $3.9 billion more than initially anticipated, with another $1.3 billion expected. Total receipts increased 6.5% through December 31st due to settlements and assessment revenues. Tax collections through the first three quarters increased 1.5% Spending from All Funds through December 31st was up by 5.3% from a year earlier, because of Medicaid and spending for education.
Matthew Libous has waived his right to a jury trial, according to U.S. District Court, Southern District of New York, which will bring his case will go before a judge in a bench trial. Matthew Libous was indicted by a federal grand jury following allegations of obstructing the IRS & filing false tax returns. Matthew Libous is the son of Area State Senator Tom Libous.

Delaware County Sheriff's Deputies identified the person and vehicle sought in a Sands Creek Road, Town of Tompkins burglary investigation. 32-year-old Justin Biedekapp of Hancock, confessed to the crime to authorities after surveillance photos & information were released to the media. Biedekapp was charged with 2nd degree Criminal Trespass & was issued an appearance ticket returnable in the Town of Tompkins Court at a later date.
Governor Cuomo presented the second part of his "2015 Opportunity Agenda" Thursday at a presentation in Rochester, to discuss the $1.5 billion Upstate New York Economic Revitalization Competition to restore economic opportunity to the Upstate regions.

The proposed competition uses the Buffalo Billion’s proven model, Projects exhibiting region-wide impact will be made a priority and should focus on strengthening critical infrastructure, revitalizing communities, bolstering workforce development, growing tourism, and improving quality of life. 7 regions are eligible to compete for 1 of 3 $500 million upstate revitalization funds.
Governor Cuomo recently asked the Gaming Casino Location Siting Board to consider awarding the 4th casino license to the Southern Tier Region, after awarding only 3 licenses out of 4 last month. Area State Senator John Bonacic stated that the Sullivan County choice in his district is outstanding, and should be fast-tracked to get open quickly, before considering Tioga downs:

Bonacic said that the casino in Sullivan County is projected to being over 20 million dollars a year in extra revenue to the Sullivan & Orange County areas due to the expected increased tourism to the area because of the new casino.
Nigel Saunders was found guilty of 2 counts of 2nd degree murder, 1st degree burglary 1st degree robbery and 2nd degree assault in Broome County court this morning. Saunders was on trial for the murder of 23-year-old Jordan Dordell & his fiancé in Binghamton, after only 3 hours of deliberation. Saunders will be sentenced on March 27th.
The state Department of Health inappropriately paid more than 29,000 pharmacy claims worth nearly $1 million over a 27-month period for thousands of Medicaid recipients whose benefits were already covered by other plans, according to an audit released today by State Comptroller Tom DiNapoli. A second audit released today found another $61,711 in overpayments to providers because of incorrect Medicare coinsurance, copayment or deductible amounts. DiNapoli recommended that the DOH Review and recover improper overpayments; instruct providers to bill Medicare Part C claims in accordance with existing requirements, & assess all claims that auditors did not examine in detail and determine if overpayments were made that warrant recovery.
The National Baseball Hall of Fame and Museum in Cooperstown announced today that an Arizona Diamondbacks logo will appear on the cap of the Hall of Fame plaque for 2015 Hall of Fame electee Randy Johnson. The cap selections for Pedro Martinez and John Smoltz will be announced on January 22nd Craig Biggio played his entire career with the Houston Astros. This year’s Hall of Fame Class will be inducted into the National Baseball Hall of Fame on Sunday, July 26th in Cooperstown.
The Chenango County Sheriff's Department arrested 19-year-old Maxwell Horton of Sherburne for unlawful possession of marihuana. Deputies arrested Horton following a traffic stop for vehicle and traffic violations and during the investigation of the traffic stop deputies found Horton to be in possession of marihuana. Horton was released on an appearance ticket for Village of Sherburne court on a later date.
