Broome County District Attorney Steve Cornwell announced
today that 31 year old Johnnah DeGraw of Deposit has been sentenced to 12 years
in prison plus 5 years post release parole for distributing fentanyl, heroin
and methamphetamines. DeGraw pleaded
guilty in Broome County Court to drug charges on March 14, Degraw And
26-year-old Marlon Graham of Deposit were arrested last November, Graham also pleaded guilty and will be
sentenced in May.
The State Budget is expected to get wrapped up quickly as
the Budget deadline is midnight on Monday.
Among the items expected to make it into the final budget plan, the
permanent installation of a 2% Property tax Cap, a ban on plastic grocery bags,
Items that have been removed from the Budget plan, the expansion of the bottle
bill, recreational marijuana & the governors plans to cut the Aid to
Municipalities.
On April 1, a new law will go into effect that bans the sale
of smoke alarms with removable batteries within New York State. Under the new law, the only battery-powered
smoke alarms permitted to be sold in New York are those equipped with
sealed-in, non-removable batteries capable of powering the device for at least
10 years.
The State Department of Taxation and Finance today reminded
taxpayers that the deadline to submit their personal income tax returns is
Monday, April 15th. After 3 years of
receiving a few extra days to file because of certain holidays, taxpayers
should be aware that this year Tax Day returns to its traditional date. New York taxpayers with adjusted gross
household incomes of $66,000 or less in 2018 may take advantage of
user-friendly tax preparation and filing software available at tax.ny.gov.
Super Heroes in Ripped Jeans will be bringing adoptable dogs & cats to the Houndstooth Bakery & Boutique in Sidney Saturday, during a Meet & Greet Bake Sale from 11:00 AM to 3:00 PM. Proceeds from the bake Sale will benefit the Super Heroes in Ripped Jeans Building fund.

warns New York Residents, and especially outdoor enthusiasts, that there is
expected to be a big increase in the Tick population this summer, and with
that, an increased in Lyme disease. Dress
in long sleeves and pants and consider tucking pant legs into socks, especially
if you will be walking in tall grass or wooded areas. Also, use a tick
repellant containing DEET, following the manufacturer's instructions. For prolonged outdoor activities such as
camping, look for clothing and camping gear that is treated with permethrin.
New York Attorney General Letitia James today announced a
win in a comprehensive lawsuit led by New York and 10 states and the District
of Columbia challenging the Department of Labor's Association Health Plan Rule,
which expands the criteria for forming AHPs in order to evade consumer
protections and sabotage the Affordable Care Act. The decision from the United
States District Court for the District of Columbia states that the rule is
"clearly an end-run around the ACA" and "creates absurd
results."
The U.S. Army Corps of Engineers will hold a public meeting
on April 3 to review, submit feedback and comment on the draft East Sidney Lake
Master Plan and draft Environmental Assessment.
The meeting will be held from 6 to 9 p.m. at the Sidney Town Clerk
Building, at 44 Grand St., Sidney, the meeting will include an open house
discussion with project team members from 6 to 7 p.m. A formal project
presentation and question and answer session will begin at 7 p.m. followed by
another open house discussion from 8 to 9 p.m.

State Police and local law enforcement will conduct special enforcement efforts designed to deter drinking and driving during St. Patrick's Day weekend. The traffic enforcement detail runs through Sunday, Drivers can expect sobriety checkpoints, additional DWI patrols, and stings targeting underage drinking and illegal sales of alcohol to minors during the campaign. State Police will also be ticketing distracted drivers who use handheld electronic devices. During the 2017 St. Patrick's Day weekend enforcement effort, Troopers made 229 arrests for DWI and issued nearly 15,000 tickets.
The Chenango County Sheriff’s Office arrested Morgan Cleveland of Norwich for 1 count of Criminal Contempt, after Cleveland allegedly violated an order of protection that was issued in February by the Town of Norwich Court. Cleveland was arraigned in the Town of Guilford Court and remanded to the Chenango County Correctional Facility on bail; he will appear in the Town of Norwich Court at a later date.
State Police arrested John Griffioen for Reckless Endangerment & Disorderly Conduct, after troopers discovered that Griffioen deliberately caused a traffic hazard by parking his vehicle in the middle of West Hill Road in the town of Worcester, which almost caused a school bus with 31 passengers to collide with his vehicle. He is accused of approaching the bus and shouting at the bus driver. Griffioen was released on appearance tickets and is due in the town of Worcester Court on March 20th.
State Police arrested 39 year old Jillenia Murphy of Afton for DWI, Obstructing Governmental Administration and several traffic infractions. Troopers were dispatched to Oak Hill Road in the town of Afton for a 1-car accident, they located Murphy and her vehicle stuck in the snow. Murphy refused to submit to a breath sample or allow troopers to take her fingerprints and was charged with obstructing governmental administration. Murphy was arraigned and remanded to the Chenango County Correctional Facility on $500 cash bail or $2,000 bond; she faces court action in the town of Afton Court & Town of Unadilla Court on March 26th.
Chenango County Sheriff’s Deputies arrested 21 year old Armoni Prince of Endicott for Criminal Mischief, after deputies responded to a domestic dispute in the Town of Greene. Prince is alleged to have destroyed the cellular phone of the victim who was attempting to contact police for assistance. Prince was arraigned in the Town of Greene Court and was released on recognizance and is to reappear in court at a later date.

State Police arrested 46 year old Marc McKercher of Union for Attempted Arson, after troopers received a complaint of 2 suspicious devices on the front steps and front lawn of a residence on King Street in Endwell. Further investigation revealed the items were improvised explosive devices which did not detonate successfully. State Police Bomb Disposal Unit was called to the scene and rendered the items safe. They secured the items from the scene, the investigation is continuing.
State Senator Fred Akshar will hold his next Town Hall Meeting in Bainbridge tomorrow at the Town Hall Theatre. Constituents are invited to attend from 11:00am to 12:30pm

Gemberling was charged with 2 counts of Criminal Possession of a controlled substance, resisting arrest and on 2 active warrants, he was remanded to the Chenango County Jail & will appear in Chenango County Court and Town of Norwich court at a later date.

Broome County District Attorney Steve Cornwell confirmed today that Orlando Tercero has been apprehended by authorities in Nicaragua. Cornwell said that his office is working with the Binghamton Police Department to prepare the case of the homicide of Haley Anderson for a Grand Jury to consider, if Tercero is indicted, Cornwell's said that they will file for a warrant, & with the assistance of the federal Department of State, will present their case to Nicaraguan authorities, to extradite Tercero to Broome County. Anderson's body was found at 23 Oak Street Friday, at Tercero's apartment, Tercero flew to Nicaragua before authorities discovered Anderson's death,
State Police arrested 23 year old Rebecca Loucks of Cherry Valley for felony Aggravated DWI With a Child, Obstructing Governmental Administration and Unlawful Possession of Marihuana. Loucks was observed by troopers driving erratically, After troopers stopped the vehicle, they observed a one year-old child in the vehicle. Loucks is accused of Driving While Intoxicated and having marijuana in her possession. After a brief struggle with troopers, Loucks was arrested, she is scheduled to appear in the town of Cherry Valley Court on March 28th.

State Police arrested 35 year old Derek Miller of Afton for felony of Aggravated Driving While Intoxicated, after Miller crashed his vehicle on January 27th in the town of Colesville. Miller’s B.A.C. was .18% when he crashed, he is scheduled to appear at the town of Colesville court on March 21st to answer to the charge.
State Police arrested 20 year old Zoe Ring of Otego, for DWI, following the report of a vehicle off the roadway on Hanley Road in the town of Otego. Ring was released on an appearance ticket and is scheduled to appear in the town of Otego Court on March 29th.
The DEC has rescheduled the public meeting to roll out the Joint Fisheries Investigation Plan for the Upper Delaware River. The new date is March 22 at 6pm. The meeting will be at the Hancock High School, 67 Education Lane, Hancock NY. All members of the public are encouraged to attend!
The DEC reminds residents that residential brush burning is prohibited March 16 through May 14 across New York State. DEC will post a Fire Danger Map rating forecast daily for the 2018 fire season on its website and on the NY Fishing, Hunting & Wildlife App available on DEC's website. Currently, fire conditions in most of the state are low risk. Open burning of debris is the largest single cause of spring wildfires in New York State. When temperatures are warmer and the past fall's debris and leaves dry out, wildfires can start and spread easily and be further fueled by winds and a lack of green vegetation. In the eight-year period since the ban was established, the average number of spring fires per year decreased by 36.7 percent, from 2,649 in 2009, to 1,677 in 2016.
About 185 environmental groups are urging state lawmakers and Governor Cuomo to pass legislation this session, banning plastic bags at retails stores. many localities have already banned those bags, others have imposed fees on those & other types of bags. New York City had planned to institute a fee on plastic bags to encourage re-use, state lawmakers blocked that rule from taking effect.

Harrington initially was charged in connection with a fight that was reported at a town of Colesville residence Monday afternoon, He originally faced counts of criminal obstruction of breathing and harassment. He was arraigned and released on his own recognizance, and an order of protection was issued. Troopers were called back to the Colesville home early Monday evening when Harrington returned. He was arrested again. This time he was charged with criminal contempt. Harrington was ordered held on $5,000 bail.

62-year-old Almond Upton of Florida was sentenced to life in prison without of parole for deliberately running down State Trooper Christopher Skinner on I-81 in 2014. Upton was sentenced today in Broome County Court by Judge Joseph Cawley, following the 1st degree murder conviction for deliberately crossing several lanes to strike Trooper Skinner while he was conducting an unrelated routine traffic stop, at an excessive speed.
Crowds gathered at the Eichler residence on Country Club Road in Oneonta this morning to witness a 94-foot Norwegian Spruce tree being removed; it will become the 2nd tallest Rockefeller Center Christmas Tree ever. The tree was removed this morning; it will be transported to New York City, where the set up will begin Saturday. The tree will be lit up as part of a nationwide broadcast on November 30th.

Broome County native David Sweat pleaded guilty to charges brought against him after he escaped from the Clinton County prison in Dannemora earlier this year. Sweat pleaded guilty to 2 counts of escape and 1 count of promoting prison contraband, for the June jail break with Richard Matt, Sweat was on the run for 22 days until he was found near the Canadian border. He was shot & injured by a state trooper 2 days after Matt was shot & killed by police. Sweat is now serving his time at Five Points Correctional Facility in Romulus, he was previously sent to jail for the murder of Broome County Sheriff's deputy Kevin Tarsia in 2002.

Governor Cuomo announced households that need help paying their heating bills this winter can begin applying for assistance from the Home Energy Assistance Program on Monday, November 16th. Eligible households can receive a one-time benefit of up to $625 this winter depending upon income, household size and heating source. Last winter, 1.48 million households received benefits through the program, in the Southern Tier; over 56,000 households received assistance last year. Republican Businessman Andrew Heaney of Mill brook announced his candidacy for the 19th Congressional District. Heaney has not held an elected office, He seeks to replace Chris Gibson, who announced that he will not seek another term in Congress at the conclusion of his current term, John Faso & Pete Lopez have already announced their intentions to seek the 19th district congressional seat.
Delaware County Deputies arrested 29-year-old Veronica Winchell of Andes, Monday as a fugitive from justice. Winchell is wanted by the State of Florida on an arrest warrant issued on October 22, for violating the terms of her probation that were imposed upon her conviction for possession of a weapon by a convicted felon. She was arraigned in the Town of Delhi Court on November 10, 2015 and was remanded to the Delaware County Jail to await further court action.
State Police arrested 44-year-old Danny Stone of Conklin, for grand larceny. Troopers received a report that Stone had been paid a down payment of $2500 to build a shed in the Town of Kirkwood in January and was never seen again. Stone was issued a ticket returnable to the Town of Kirkwood court on November 17.
State Police arrested 25 year old Jon Speller of Oneonta, for criminal trespass, after troopers responded to a complaint from a woman sleeping at the Budget Inn on State Route 23 in the Town of Oneonta, who complained that she woke up to Speller crawling through her outside window and entering her room without permission. Troopers located him sleeping in another room when he was arrested. Speller was arraigned at the Town of Oneonta Court and released on his own recognizance. His next court date in the Town of Oneonta is on December 10th.

The State DOT announced that construction work for the Prospect Mountain project will be performed and will require lane closures in the City of Binghamton and the Town of Dickinson, all this week from 6:00 PM to 6:00 AM. Concrete pavement work will be performed on I-81 Northbound between Exit 4 Binghamton and Exit 5 Front Street, the highway will be reduced to one lane. Motorists are advised to be alert for slow moving traffic and sudden stops.

Troopers located him sleeping in another room when he was arrested. Speller was arraigned at the Town of Oneonta Court and released on his own recognizance. His next court date in the Town of Oneonta is on December 10th.
The State DEC announced that Veterans Day, November 11 is now a designated annual free fishing day in New York State. No license is required to fish in any of the state's 7,500 lakes and ponds or 50,000 miles of rivers and streams during state-designated free fishing days. Anglers are reminded that although the requirement for a license and enrolling in the Recreational Marine Fishing Registry has been waived during free fishing weekend, all other regulations remain in effect.
The Oneonta Veteran's Club is inviting all veterans and the public to a ceremony Wednesday at Neahwa Park's Veterans Memorial Walkway at the east end, under the American Flag. The ceremonies will begin at 11:00 AM Wednesday.
A fundraiser for the Delaware valley humane society will be held this Sunday at the Houndstooth Bakery & Boutique on Main Street in Sidney, where area pet owners can have pictures of their pets professionally taken for the holidays. Terri Heath of the Delaware Valley Humane Society explains:

The State DOT announced that construction work for the Prospect Mountain project will be performed and will require lane closures in the City of Binghamton and the Town of Dickinson, all this week from 6:00 PM to 6:00 AM. Concrete pavement work will be performed on I-81 Northbound between Exit 4 Binghamton and Exit 5 Front Street, the highway will be reduced to one lane. Motorists are advised to be alert for slow moving traffic and sudden stops.
