The Joint Landowners Coalition of New York will file its lawsuit against New York State today, The action seeks an Order: Compelling the DEC to finalize the environmental impact statement on hydrofracking, Determining that the DEC referral of the statement to the health department was arbitrary and capricious, & that Governor Cuomo is acting without jurisdiction by orchestrating the delay and interfering with the DEC’s independent decision-making authority. The Coalition is represented by Mountain States Legal Foundation and Levene Gouldin & Thompson.

The Joint Landowners Coalition of New York announced today that the Mountain States Legal Foundation has agreed to assist with their lawsuit against the New York State. The coalition lawsuit demands that the DEC identify a date when the Environmental Impact Statement on hydrofracking will be completed and permit applications will be processed. Coalition president Dan Fitzsimmons told WCDO News that activists have slowed down this process with unsubstantiated claims:

Fitzsimmons said that if the state fails to comply on or before February 13th the Mountain State Legal Foundation would file an Article 78 Petition asking a court to compel DEC to complete the statement pursuant to the requirements of the State Environmental Quality Review Act.
